Making progress on transgender rights

There have been some huge developments on the Civil Rights in Education front over the past few weeks and we wanted to make sure that you knew exactly what this means. Last week, the Departments of Education and Justice issued joint guidance clarifying, in detail, that Title IX of the Education Amendments of 1972 protects transgender students from discrimination and what schools can and cannot do. The Department of Education has previously defined sex discrimination to include gender identity, but this is the first time they have issued guidelines and recommendations for how schools should specifically support transgender students. The guidance provides a strong base affirming that schools must respect and use the names and pronouns as asserted by students and that students do not need parental approval to have their rights respected. The departments took a step further in additionally issuing a detailed guide compiling the best emerging practices from schools across the country. Here also is the latest guidance, issued last summer, from the state Board of Regents. more
