Case Studies: Responding to General Duty Clause Enforcement at ChemEdge 2016

When the U.S. EPA first enacted Section 112(r)(1) of the Clean Air Act — also known as the General Duty Clause (GDC) — in 1990, it was used largely in the context of accidents after they occurred. More and more, however, the agency is trying to use General Duty as a means to prevent accidents before they occur and, as a result, continues to step up its enforcement efforts. At ChemEdge on Aug. 18, Kestrel Management's Thomas Kunes and David Tripp of Stinson Leonard Street LLP will highlight recent case studies in which chemical distributors have had to respond to GDC enforcement. These particular enforcement cases involve conducting third-party audits at chemical distribution facilities to ensure compliance with the requirements of CAA Section 112(r)(1) — GDC — and other regulations is thoroughly evaluated.
