OP-ED: Guilty before conviction — pretrial probation

The current trend in the justice system is to treat citizens as guilty prior to trial. The California Constitution guarantees the right to surety bail. Certain constitutional rights are outside the purview of government oversight that is why that are enshrined as part of the Bill of Rights, e.g., freedom of religion, freedom of speech and freedom of the press. In this matter, we are addressing Californian's constitutional right to surety bail. The courts often get involved in resolving whether or not a particular kind of conduct is in fact: speech, religion or press, but once that determination is made the usual result is that the government has no oversight at all. more
