Recently, the Massachusetts Supreme Judicial Court dealt a severe blow to a three-prong effort by the natural gas industry, manufacturing interests and the LePage administration to levy a multi-billion-dollar tax on electricity customers to subsidize a private, interstate gas pipeline through­­ New England. In its decision, the Court ruled that it is unlawful to charge residential rate payers to underwrite long-term contracts for natural gas pipeline capacity because it would undermine the state's 1997 Restructuring Act, which aimed to use "competitive market forces to reduce prices and provide customers with choice of their retail electricity supplier." more
