For years, ASA and others in the retail and brick-and-mortar world have pushed Congress to revisit the long outdated 1992 Supreme Court decision that prevents businesses from collecting sales tax on out of state purchases. Caused by the growth of internet purchases and companies undermining local brick-and-mortar sellers that must include a sales tax, online sellers have only grown. Though they make negligible contribution to the communities in which they’re located. Though we’ve long advocated for Congress to act, states have begun acting themselves, to the dismay of online sellers. This has brought us to tomorrow, when the Supreme Court is set to hear oral arguments between the state of South Dakota and Wayfairer.com. ASA has supported South Dakota’s petition and has joined with others in requesting the Supreme Court takes this case. Regardless of the outcome tomorrow, Congress will continue to have the final say. more
