    Fraud and Abuse Laws

    In the past it was common for physicians to give "courtesy discounts" to colleagues and others. Unfortunately in 1996 the Health Insurance Portability and Accountability Act [HIPAA] was passed. With this and other regulations enacted these discounts became potentially illegal with significant civil monetary and criminal penalties. So today, not collecting co-payments or co-insurance may bring serious repercussions. The primary issues involve HIPAA, the Anti-Kickback Statute, Stark legislation, contractual considerations, and the effects of legislation on the provision of discounts.

    The Impact of MIPAA on Orthopaedic-Owned MRI

    The Medicare Improvements for Patients and Providers Act of 2008 (MIPAA) requires that as of January 1, 2012, all non-hospital suppliers furnishing the technical component (TC) of advanced imaging services, must be accredited by a designated accreditation organization for purposes of reimbursement. This rule applies to MRI, CT, Nuc Med and PET.

    Solo practices still lagging in EHR adoption

    The meaningful use incentive program has spurred a lot of growth in health IT use. But a digital divide still exists between solo practices and their larger counterparts, and between independent practices and those that belong to an integrated health delivery system. Between 2009 and 2012, the rate of electronic health record use among primary care physicians increased from 46 percent to 69 percent, according to a report by The Commonwealth Fund, published in the February issue of the Health Services Research journal. But, the report found, practice size was a major determinant of health IT adoption.

    CMS: Full ICD-10 testing coming this summer

    Federal health officials will conduct end-to-end testing of ICD-10 billing code submissions with a limited number of providers this summer, the Centers for Medicare and Medicaid Services announced. "The small sample group of providers who participate in end-to-end testing will be selected to represent a broad cross-section of provider types, claims types, and submitter types," the CMS announcement read.

    Private exchange sees surge in healthcare enrollment
    USA Today
    The number of customers on the nation's largest private health insurance exchange increased by 50 percent in the final three months of 2013, a direct result of demand created by the Affordable Care Act, the company's CEO said. Gary Lauer, CEO of eHealth Insurance, said individual memberships rose 50 percent in the fourth quarter of 2013 compared with the same period in 2012, from 113,600 applications in the last three months of 2012 to 169,800 in 2013.

    HITPC: Stage 3 meaningful use to focus on patient safety, quality

    The Health IT Policy Committee's newest draft recommendations for Stage 3 Meaningful Use are taking a good hard look at quality, patient safety, and timely interventions through population health management and clinical decision support. The suggestions for eight objectives for the third state of the EHR Incentive Programs will lead the transition from using EHRs for data entry to using comprehensive health IT infrastructure to provide patient-centered care with an emphasis on engagement, care coordination, and safety.

    Doctors without state borders: Practicing across state lines

    In the United States, a tangled web of federal and state regulations controls physician licensing. Although federal standards govern medical training and testing, each state has its own licensing board, and doctors must procure a license for every state in which they practice medicine (with some limited exceptions for physicians from bordering states, for consultations, and during emergencies).

    US health insurers brace for new steep Medicare cuts

    The U.S. government is expected to announce the proposed payment rates for insurer-run Medicare plans in 2015, but industry officials say the anticipated cuts will mean higher co-pays and fewer benefits for seniors. Of the more than 50 million older Americans who receive coverage through Medicare, about 15 million are enrolled in Medicare Advantage plans offered by companies such as UnitedHealth Group Inc, Humana Inc and Aetna Inc. The rest use Medicare fee-for-service programs, in which doctors are reimbursed by the government for patient visits and procedures.

    California voters may decide medical malpractice cap

    A protracted political battle over California's medical malpractice law may be coming to a new front: the voting booth. For decades, trial lawyers and consumer groups have railed against limits on certain damages in malpractice cases, arguing that such restrictions deny victims fair compensation for grisly medical mistakes.
