    No Authorization Required: Permitted Uses and Disclosures of PHI
    AAOE
    The purpose of the Privacy Rule is to protect individually identifiable health information by limiting its use and disclosure. The Rule does allow providers to use and disclose PHI for specific purposes, however, without the patient's authorization. The following are 6 circumstances where use and disclosure of an individual's protected health information is considered permissible without authorization.

    House passes budget deal with 3-month 'doc fix'

    The House overwhelmingly passed a bipartisan budget agreement that will postpone a nearly 24 percent cut in Medicare pay for physicians from Jan. 1 until April 1 and instead give them a 0.5 percent raise during that period. The delay buys time for lawmakers to consider another bipartisan bill to permanently repeal Medicare's sustainable growth rate formula, which will trigger the massive pay cut next year.

    Reactions mixed to announced meaningful use changes

    A new proposed timeline for the meaningful use incentive program for electronic health record use was announced by the Centers for Medicare and Medicaid Services and the Office of the National Coordinator for Health IT. The change came with mixed reaction from many healthcare member organizations advocating for more flexibility in the incentive program. It was also met with some initial confusion over what the revised timeline means.

    A crisis in physician recruitment

    Over the next seven years, an estimated 6.5 million new healthcare jobs will be have to be filled, according to the Bureau of Labor Statistics. A large number of those positions will be for physicians. Healthcare HR managers will find it challenging to fill the majority of new jobs in the fast-growing healthcare industry, which will be for nurses, aides, and support staff. But it's the need for more physicians that doesn't bode well for the industry, based on the current state of physician hiring.

    The battle between doctors and trial lawyers grows more infantile

    California initiative campaigns have a way of reducing all important public policy issues to their lowest intellectual denominators — and highest financial numerators. The coming battle over the state's medical malpractice limits looks certain to set records in both categories. We've written before about the necessity of modernizing MICRA, the Medical Injury Compensation Reform Act of 1975. Even its drafter acknowledges that it was botched at birth; because its limit of $250,000 on pain-and-suffering recoveries isn't indexed to inflation, it serves merely to shut the courthouse door to the victims of medical malpractice.

    Mental Health Parity and Addiction Equity Act: The basics for providers

    The departments of Treasury, Labor, and Health and Human Services recently issued the final rules implementing the Mental Health Parity and Addiction Equity Act of 2008, or MHPAEA. This Act requires that group health plans that offer mental health or substance use disorder benefits apply the same type of financial requirements and treatment limitations that the plan applies to medical and surgical benefits.
