    Upcoming Federal Oil Pipeline Regulation Primer
    EBA
    The Energy Bar Association will present a primer on oil pipeline federal regulations next Monday and Tuesday (January 26-27, 2015) in Houston, Texas. The primer will provide an overview of the federal economic regulation of oil and refined products pipelines. Industry practitioners and regulators will instruct the course, including:
    • Derek Anderson, an Attorney Advisor with FERC’s Office of General Counsel focusing on oil pipeline matters
    • Glenn Benson, a partner at Davis Wright Tremaine LLP, has over two decades of experience advising oil pipelines, producers, refiners and marketers on a wide variety of federal and state regulatory matters
    • Michelle Boudreaux, a partner at Caldwell Boudreaux Lefler PLLC, represents clients in federal and state law governing the transportation of energy commodities by pipeline
    • Shannon Colemand, a Senior Attorney for Colonial Pipeline Company, counsels the Shipper Relations and Scheduling groups on FERC compliance matters.
    • Adrianne Cook, a Senior Energy Industry Analyst with FERC’s Division of Pipeline Regulation in the Office of Energy Market Regulation, primary focus is on oil and natural gas matters.

    Supreme Court appears split over FERC's regulatory reach

    Major natural gas producers argued to the Supreme Court today that a federal law shields them from state antitrust lawsuits stemming from the California energy crisis. ONEOK Inc. v. Learjet Inc. concerns whether the Natural Gas Act pre-empts local antitrust lawsuits filed against natural gas producers for price manipulation. The case may determine the scope of the Federal Energy Regulatory Commission's jurisdiction over regulating wholesale natural gas prices and markets.

    Obama pushes new methane limits for gas drilling, industry says 'energy renaissance' at risk

    The Obama administration pushed new regulations Wednesday aimed at cutting methane emissions from the natural gas sector, calling the proposed rules a needed step to address global warming as industry groups warned the move would threaten "America's energy renaissance." Relying once again on the Clean Air Act, the rules — the first of their kind — join a host of others that President Obama has ordered in an effort to slow global warming despite opposition in Congress that has only hardened since the midterm elections.

    EPA proposes expanded oversight of uranium mining

    U.S. EPA is proposing new water protection and monitoring regulations for a controversial form of uranium mining, according to a copy obtained by Greenwire. Administrator Gina McCarthy signed the proposed rule Dec. 31, and the agency is scheduled to make it public in the near future. The proposal comes under EPA's effort to address concerns surrounding in-situ recovery uranium extraction sites. In-situ recovery, also known as in-situ leach, involves injecting fluids underground to free uranium deposits, which are then pumped out. It is now, where geologically possible, the preferred method for uranium mining.

    California strives to take lead in overseeing fracking

    Final regulations are now in place to establish what will become the most comprehensive state oversight of hydraulic fracturing in the nation, but two key parts of California’s landmark 2013 law remain unfinished. The regulations were certified by the Office of Administrative Law on New Year’s Eve, beating the law’s Jan. 1 deadline by hours. But an independent scientific study on the safety of the oil-drilling practice and an environmental impact report that will identify issues well-operators must address before receiving a permit are still being developed. The draft EIR and the first volume of a three-part scientific study are expected to be released this month, possibly by the end of this week.

    The Energy Bar Association’s Ad Hoc Committee on Energy Law Education will present its work-in-progress on energy law curricula and, particularly through our workshop session, seek input on how energy law should be taught and integrated into curricula within and outside of law schools at the 1st annual National Energy Education Summit on January 26 at the Hyatt Regency Crystal City, Arlington VA. The Summit, which is sponsored by the Council of Energy Research and Education Leaders (CEREL), will precede the 15th National Conference and Global Forum on Science, Policy and the Environment, sponsored by the National Council for Science and Environment on January 27-29, which this year is focused on Energy and Climate Change.

    EBA Primer Series: An Introduction to Federal Oil Pipeline Regulation

    EBA will hold its fourth program in the EBA Primer Series…An Introduction to Federal Oil Pipeline Regulation in Houston, TX on January 26-27, 2015. The goal of this primer is to provide an overview of the federal economic regulation of oil and refined products pipelines. Taught by industry practitioners and regulators from the Federal Energy Regulatory Commission, the course begins with a brief overview of the oil and refined products pipeline industry and then describes key statutes and regulations governing and affecting the transportation of oil and other liquid petroleum products. Instructors explain important legal and regulatory concepts and requirements, pipeline services, the scope and limits of FERC and state jurisdiction and key issues affecting the industry.
