FERC's McIntyre says tax cut issues on the table

Chairman Kevin McIntyre said yesterday that the Federal Energy Regulatory Commission is looking into what the agency could do to ensure that rates paid by consumers reflect the large decline in the federal corporate tax rate enacted late last year. Speaking with reporters after FERC's monthly meeting, McIntyre said, "We'll begin with figuring out specifically what the law requires and/or permits, and go from there to what's the appropriate policy decision."
Appeals court to hear suit against Interior challenging effects of coal mine leasing
A federal appeals court will hear a case brought by environmentalists suing the federal government over the environmental impacts of its coal-leasing program. The D.C. Circuit Court of Appeals announced Jan. 16 it will hear an oral argument in March over the lawsuit, brought by the Western Organization of Resource Councils and Friends of the Earth against Interior Department Secretary Ryan Zinke.
House GOP looks to give FERC final say on natural gas exports
Republicans and Democrats sparred Jan. 19 over legislation to make the Federal Energy Regulatory Commission the gatekeeper for approving natural gas exports. The current process provides for a two-step process in which FERC’s primary siting approval must be evaluated and approved by the Department of Energy, which has typically dragged its feet before issuing final decisions on export decisions.
FERC approves PennEast pipeline
The Morning Call
The controversial PennEast pipeline, a 120-mile natural gas line that would cut through Northampton County on its way from the Marcellus Shale production area to New Jersey, received federal approval Jan. 19. In its 106-page decision, the Federal Energy Regulatory Commission said the market benefits PennEast will provide outweigh any adverse effects it could have on existing shippers, other pipelines, landowners and communities. Adverse environmental impacts can be reduced through mitigation efforts, the decision said.
European Union moves to strengthen renewable-energy goals
European lawmakers have backed measures that would substantially raise the European Union’s clean-energy ambitions. By 2030, more than one-third of energy consumed in the EU should be from renewable sources such as wind and solar power, the European Parliament says — up from the existing target of just over one-quarter. But the decision is not yet legally binding: The Parliament will now need to negotiate the plan with national governments, which could attempt to lower the targets.

Call for Nominations for Boards of EBA, FELJ and CFEBA
EBA's Committee on Nominations is seeking nominations to fill officer and director positions on EBA’s Board of Directors as well as potential candidates to serve as directors of EBA’s affiliated Foundation of the Energy Law Journal (FELJ) and Charitable Foundation of the Energy Bar Association (CFEBA). Officers and directors of the FELJ and CFEBA boards are appointed by the incoming EBA president and ratified by the EBA Board, but your recommendations are helpful in identifying interested and qualified candidates. The election to fill these positions will occur at EBA’s Annual Meeting on May 8, 2018.

How FERC Addresses Ethics Issues, Subject of February 15 EBA Energizer
A diverse panel of experts will explore a range of topics that implicate ethics, from ex parte communications, to issues arising out of the Model Protective Order, to practices before and during hearings at FERC.
