    EBA Annual Meeting (May 5-6, 2015) Session Update: Do We Need a New Way to Regulate Electric Utilities?

    The Energy Bar Association (EBA) has finalized speakers for the EBA Annual Meeting and Conference on May 5-6, 2015. The session entitled, Do We Need a New Way to Regulate Electric Utilities will be presented on Wednesday, May 6.

    The session will focus on traditional regulatory models rewarding utilities for building new generation, transmission and distribution facilities to deliver reliable, affordable energy. However, today, customers are installing their own on-site distributed energy resources and using data, internet-based applications and smart technologies to manage their energy use. Because of this, utilities are facing demands to meet new environmental challenges, support energy efficiency and build a grid that is smarter and more resistant, resilient and hospitable to new technologies like electric vehicles and storage.

    Case Summary: Perez vs. Mortgage Bankers Association

    On March 9, 2015, in a unanimous decision, the United States Supreme Court (Court) reversed a decision from the United States Court of Appeals for the District of Columbia (D.C. Circuit) which held that the Department of Labor (Department) failed to comply with the Administrative Procedure Act (APA) when it modified one of its interpretative rules without providing opportunity for notice and comment. The Court specifically found that the lower court’s reliance on Paralyzed Veterans of American v. D.C. Arena L.P., 117 F.3d 579 (D.C. Cir. 1997) was in error as Paralyzed Veterans is directly contrary to the language found in the APA. The Court held that the APA does not require a federal administrative agency to provide notice and comment when it proposes to change/modify an interpretative rule as interpretative rules are exempt from such requirement under § 4 of the APA.

    Breaking Rules and Changing the Game: Will Shale Gas Rock the World?

    In the current issue of the Energy Law Journal, author Christopher Goncalves, at the Berkeley Research Group, explores the evolution of shale gas impacts on global LNG markets in his article entitled "BREAKING RULES AND CHANGING THE GAME: WILL SHALE GAS ROCK THE WORLD? Mr. Goncalves evaluates the implications of shale gas for future change in terms of LNG trade, pricing, economics, environment, and geopolitics. Mr. Goncalves first evaluates the early historical impacts on LNG trade and markets as North American shale production has boomed in the period from 2006 through 2013. Next, the article explores how the early effects may have been a harbinger of greater trade and pricing impacts to come as North American LNG exports ramp up for the period between 2015 and 2020, considering the likely evolution of global supply and demand, critical commercial developments already underway, as well as potential constraints and impediments on the near horizon. Finally, the article explores the potential long term impacts if foreign LNG buyers are successful at importing not only North American LNG but also the underlying shale gas revolution – in terms of the technology and know-how − and industry conditions needed to achieve the sort of large scale, low cost production achieved in North America.

    Wind could supply a third of the country's power needs by 2050, government says
    The Washington Post
    Wind power could provide more than a third of the country's electricity by 2050 while yielding a net savings in energy costs paid by consumers, the Energy Department reported in a major study released Thursday, March 12. Continued growth of wind energy — which has tripled since 2000 and now supplies nearly 5 percent of the country's electric power — also could dramatically reduce air pollution and go a long way toward meeting the country’s goals on slowing climate change, the report said.

    US petroleum product exports increase for 13th consecutive year, setting record

    U.S. exports of noncrude petroleum products from the United States averaged a record 3.8 million barrels per day (bbl/d) in 2014, an increase of 347,000 bbl/d from 2013, based on data from EIA's Petroleum Supply Monthly. In particular, exports of motor gasoline, propane, and butane increased, offsetting a decrease in distillate exports.

    Emissions stall amid growth for first time in 40 years, IEA says

    Global emissions were unchanged in 2014, the first time that's happened amid economic growth in four decades, according to the International Energy Agency. Carbon-dioxide emissions, which scientists say are responsible for climate change, were stable at 32.3 billion metric tons, even as the global economy advanced 3 percent, the Paris-based agency said Friday in a statement on its website, citing preliminary estimates. China, the world's biggest emitter, generated more of its electricity from renewable sources including hydropower, solar and wind and less from coal, the dirtiest fossil fuel, it said.

    CFTC enforcement chief to revive use of in-house courts

    The U.S. derivatives regulator's enforcement director said on Thursday, March 12, that his division planned to revive the use of in-house administrative courts, after more than a decade of bringing contested cases only to federal courts. "We are going to start to do that very soon," said Aitan Goelman, the enforcement chief of the Commodity Futures Trading Commission, in remarks at Georgetown Law's Corporate Counsel Institute. He added that the move would help the agency, which has a very constrained budget.
