The Energy Bar Association (EBA) has finalized speakers for the EBA Annual Meeting and Conference on May 5-6, 2015. The session entitled, Will Your Mandatory Compliance Program Pass Muster will be presented on Tuesday, May 6.
In this practical session, an expert panel will explore the Federal Energy Regulatory Commission (FERC) enforcement processes and share must-have components of an effective regulatory compliance program.
Cost-pooling agreement decision upheld
On February 20, 2015, a three-judge panel of the United States Court of Appeals for the District of Columbia Circuit (Court) unanimously upheld a decision by the Federal Energy Regulatory Commission (FERC) approving a cost-pooling agreement among the owners of the Trans Alaska Pipeline System (TAPS). The Court did not find persuasive Petitioners’ claims that FERC’s approval of the pooling agreement, which allocated nearly 75% of fixed costs among the TAPS owners on the basis of combined interstate and intrastate usage, constituted impermissible regulation of intrastate pipeline transportation. The Court held that § 5(1) of the Interstate Commerce Act (ICA) gives FERC authority over intrastate traffic where FERC determines it to be a necessary incident to regulation of interstate traffic. In this case, FERC’s policy in favor of uniform rates constituted sufficient justification for the incidental effect on intrastate commerce of the pooling agreement.

Did you know that the annual reception honoring the FERC Administrative Law Judges is the major source of funding for the Energy Law Journal? Unfortunately, in recent years the Journal has been incurring an operating deficit averaging slightly more than $30,000 per year. This deficit had been covered by funds in an investment corpus that was created from EBA membership dues when the Foundation of the Energy Law Journal was created to fund the Journal’s operations. Current EBA membership dues do not fund the Journal. Ultimately, continuing to publish the Journal with an operating deficit is not sustainable. For the last several years the Foundation’s Board has significantly reduced operating expenses, including transitioning to the electronic distribution of the Journal, and it has begun to look for additional sources of funding, including funding from the annual ALJ reception.
The Journal is a great resource for all of us in the Energy Bar and related professions so we want to ensure its long-term financial viability. If your firm is eligible to sponsor the reception, please support the Journal by becoming a sponsor. To comply with ethics rules, sponsorship is limited to firms that will not be parties in a proceeding before the ALJs, although the firm may represent a party in a proceeding. Americans split on support for fracking in oil, natural gas
The practice of hydraulic fracturing, or "fracking," has emerged as a divisive issue across the U.S., reflected in Americans' opinions about it; 40 percent of Americans say they favor the procedure, while 40 percent oppose it, and a substantial 19 percent do not have an opinion. This is amid the Obama administration recently announcing the first nationwide safety rules for fracking.
EPA rule on power plant emissions faces formidable hurdle in Supreme Court

Twenty-five years in the making, a new nationwide rule is set to take effect this spring that will sharply restrict coal and oil-fired power plants from releasing mercury, arsenic and other hazardous pollutants into the air and, eventually, into rivers and lakes. But the rule faces a final and formidable hurdle when the U.S. Supreme Court hears arguments from lawyers for the coal and power industries, who say it may be "the most costly rule" ever adopted under the Clean Air Act.
FERC to investigate CAISO energy imbalance market over price spikes
Utility Dive reported recently on the successes of the California Energy Imbalance Market's first few months in operation, but now FERC is looking at the market for what it says is enhanced price volatility. California's grid operator requested FERC extend for a year a waiver that allows more flexibility to setting the marginal economic bid, but regulators have rejected that idea.
McConnell to states: EPA climate rule is illegal
Senate Majority Leader Mitch McConnell, R-Ky., is doubling down on his advice that states ignore the Obama administration’s climate rule for power plants.
McConnell sought to reassure governors in a letter March 19 that they would be on firm legal ground and not violating the law if they decline to formulate plans to implement the Environmental Protection Agency’s (EPA) carbon limits.
New Developments in DC Energy
The Energy Bar Association is partnering with the Women’s Bar Association to present a discussion on new energy initiatives in the District of Columbia on March 26, 2015. Topics range from Capitol Partners Solar Project to microgrids and will have a Q&A session following the panel.
