    EBA Primer Series: An Introduction to FERC Regulation of the Natural Gas Industry

    On May 19-20, 2014, EBA will hold its next program in the EBA Primer Series: An Introduction to FERC Regulation of the Natural Gas Industry, at the law firm of Jones Day in Chicago, IL. The goal of this primer is to provide an overview of the federal regulation of the natural gas industry by the Federal Energy Regulatory Commission. Taught by industry practitioners and regulators from FERC, the course begins with a brief overview of the natural gas industry, including the production, gathering, transportation, distribution, and storage of natural gas. The course describes key statutes governing and affecting the interstate transportation of natural gas and discusses key legal milestones. Instructors explain important regulatory concepts, pipeline services, and the scope and limits of FERC jurisdiction. The class covers key sections of the NGA, including imports and exports under Section 3; construction and abandonment under section 7; ratemaking under sections 4 and 5; and enforcement issues.

    New On-Demand Recordings now available

    Two new On-Demand Programs are now available through the EBA Online Store: Allocating Energy Governance: Sorting Out State and Local Jurisdiction over Energy Infrastructure and Operations program, presented by the Southern Chapter of EBA was recorded on Friday April 25th is now available. The speaker, Professor Hannah Jacobs Wiseman discussed disputes between state and local governments regarding the regulation of the siting and operations of renewable energy facilities and oil and gas infrastructure. It will explore state statutes centralizing jurisdiction or delegating control to local governments, recent court interpretations of these statutes, conflicts between home rule and preemption provisions, and theories that might help us decide how authority over upstream infrastructure should best be shared.

    Mastering Your First (Or Next) State Public Utility Commission Hearing video, recorded on February 13, 2014, in Washington, DC. A practical skills mock administrative hearing — Three State public utility commissioners, presided over a mock administrative hearing. The case to be argued concerned a utility's request for special accounting treatment for a utility’s large investment in a new, cleaner coal plant that can meet the EPA's pending carbon emission regulations. The mock case was tried by seasoned administrative litigators presenting expert witnesses who routinely testify on utility accounting issues. Presenters demonstrated both the dos and don’ts of appearing at your first, or next, administrative hearing.

    Water and Air Quality Issues in Oil and Gas Development:
    The Evolving Framework of Regulation and Management

    The Rocky Mountain Chapter of the Energy Bar Association is pleased to be a co-sponsor of the 2014 Martz Summer Conference, Water and Air Quality Issues in Oil and Gas Development: The Evolving Framework of Regulation and Management to be held June 5-6, 2014 University of Colorado Law School, Wolf Law Building in Boulder, CO. The 2 day program will focus on the new era of energy development in key resource rich pockets throughout the US that have been ushered in by technological advances for extracting oil and gas from shale deposits. The speakers will review the ongoing efforts of governments and industry to develop the regulatory and management practices necessary to protect water and air resources, drawing on the latest scientific research to tackle areas of uncertainty and to inform future action.

    Obama renominates LaFleur as FERC commissioner
    The Hill
    President Barack Obama renominated present acting chairwoman of the Federal Energy Regulatory Commission, Cheryl LaFleur, to serve on the commission again. LaFleur, who joined FERC as a commissioner in 2010, was named acting chairwoman in 2013, after Jon Wellinghoff stepped down.

    Magnolia LNG files formal FERC application
    Oil & Gas Journal
    Magnolia LNG LLC, a wholly owned subsidiary of Liquefied Natural Gas Ltd., Perth, has filed an application with the U.S. Federal Energy Regulatory Commission seeking authorization for the siting, construction, ownership and operation of the proposed Magnolia LNG project along the Calcasieu River, near Lake Charles, Louisiana.

    Ohio Manufacturers' Association proposes 6 fixes to state energy mandates

    The fiery debate over Ohio's renewable energy and efficiency law is back on. The state Senate Public Utilities Committee held a hearing recently discussing a bill that would freeze the state's renewable energy standards. As the meeting was being conducted, two opponents of the freeze issued recommendations to strengthen current standards.
