    Committee Spotlight — ADR Committee Activities

    During the 2013-2014 year, the ADR committee together with the FERC Practice and ALJ Committee jointly sponsored a brown-bag lunch at FERC's headquarters. The seminar examined the then recent creation, through consolidation, of FERC's Office of Administrative Law Judge and Dispute Resolution ("OALJDR"). Approximately 40 registrants attended the program in person; eight people registered for teleconference participation. A 30-minute networking session preceded the program.

    The program discussion was led by FERC Deputy Chief Administrative Law JudgeBobbie J. McCartney, and Deborah Osborne, Director of the Dispute Resolution Division of the newly-consolidated OALJDR. Judge McCartney provided an overview of the organizational changes. She explained that the new office retained all of the services previously provided, but with enhancements designed to improve the visibility and accessibility of these services. Judge McCartney confirmed that OALJDR, as restructured, is intended to be widely accessible for virtually any type of dispute implicating FERC's regulatory oversight. Judge McCartney described the benefits of early involvement of OALJDR and the various options for engaging OALJDR's services. Ms. Osborne elaborated on the functional capabilities and services available through OALJDR. Judge McCartney and Ms. Osborne offered specific examples of recent cases resolved through mediation. Several participants also weighed in with similar dispute resolution "success stories."

    Written presentation materials that were made available to participants at the program outlined the reasons for the office consolidation, the implications for FERC practitioners, and the potential advantages of dispute resolution as an alternative to litigation. Participants were encouraged to follow-up directly with Ms. Osborne with any questions, comments or feedback concerning the presentation. Submitted by EBA ADR Committee: Jeffrey G.     Northeast Chapter of EBA Holds its Annual Conference — June 12th

    You are encouraged to attend EBA's Northeast Chapter Annual Meeting on June 12, 2014. The full day program includes sessions on: Resilient Infrastructure State Initiatives; RTOs/ISOs Perspectives on Order No. 1000; Restructuring Markets Outside of the US and Exporting Liquefied Natural Gas ("LNG") Export. The keynote address will be given by Elizabeth Moore, General Counsel for Consolidated Edison. The meeting will conclude with a networking reception.

    Rocky Mountain Chapter of EBA Holds its Annual Meeting — June 20th

    The Rocky Mountain Chapter will hold its Second Annual Meeting, taking place June 20, 2014, at Xcel Energy in Denver, CO. This half-day program begins with a networking lunch and is followed by two afternoon educational panels: Rocky Mountain State Policy Panel and Current Federal Regulatory Challenges Affecting the Energy Industry of Particular Interest in the Rocky Mountain Region. In addition, the program will include the Chapter’s Annual Business Meeting and Election of Officers and end with a hosted cocktail networking reception.     Court overturns federal rule to reduce energy use
    The Associated Press via Bloomberg Businessweek
    On Friday, May 23, a federal appeals court overturned an electricity regulation that enabled utilities to pay energy users in the wholesale market to reduce consumption. The court found that the directive from the Federal Energy Regulatory Commission infringed upon state authority.

    South Carolina House votes to OK solar; energy supporters call vote historic
    The State
    South Carolina took what is considered a historic step on May 21 to change the state's longtime resistance to solar power. The state House of Representatives voted 105-0 for a solar energy bill that is forecast to make sun-generated electricity more abundant in the Palmetto State.
