    Do you have a topic in mind that you would like to see covered at the Energy Bar Association Mid-Year Meeting on November 18 and 19, 2015? If so, the EBA Professional Education Council wants to hear from you!

    What do you want to hear more about? Are you aware of emerging trends with broad industry appeal? Did you attend the Annual Meeting and/or Mid-Year Meeting and feel as if a topic was missing? If so, please take a moment to take the following survey (https://www.surveymonkey.com/s/CLKWHVD) and submit a short paragraph proposing a topic of interest on or before July 1, 2015. If you have time, include in your submission a sentence explaining the types of speakers (attorneys, business persons, consultants, etc.) you would like to see on a panel or as a keynote.

    Seeking Nominations for the Paul E. Nordstrom Service Award

    The EBA Committee on Nominations is seeking your suggestions on candidates for the Paul E. Nordstrom Service Award. This Award was created in memory of Paul Nordstrom, a past President of the Energy Bar Association (EBA) and motivating force in organizing the Charitable Foundation of the EBA (CFEBA). The first award was given to Paul posthumously; other honorees are Sheila S. Hollis, Richard Meyer, Freddie Greenberg, William A. Mogel, and Paul B. Mohler. The award honors and recognizes exemplary long-term service or a particularly significant example of public service to the community through the EBA, CFEBA or Foundation of the Energy Law Journal. Exemplary community service outside of these organizations also may be considered. A nominee must be a current or former member of EBA.     If you would like to recommend a candidate for the Paul E.     Supreme Court ruling: The EPA did not properly consider costs of the regulation
    The Hill
    In a 5-4 ruling, the justices ruled that the EPA should have taken into account the costs to utilities and others in the power sector before even deciding whether to set limits for the toxic air pollutants it regulated in 2011. The case, Michigan v. EPA, centers on the EPA’s first limits on mercury, arsenic and acid gases emitted by coal-fired power plants, known as mercury and air toxics (MATS). Opponents, including the National Federation of Independent Business, say it's among the costliest regulations ever issued. The EPA estimated its rule, which took effect for some plants in April, would cost $9.6 billion, produce between $37 billion and $90 billion in benefits and prevent up to 11,000 premature deaths and 130,000 asthma cases annually.

    Energy firms' legal risks rise as oil prices sputter

    Oil and gas companies shielding themselves from the effects of low commodity prices should tread carefully to avoid litigation, energy attorneys warned in recent talks with industry. While trimming the payroll and cutting other costs may help companies weather the oil price downturn, money-saving missteps could easily land them in court.

    Court delays federal fracking rule

    The Obama administration's long-awaited hydraulic fracturing rule will not take effect as scheduled today, thanks to a federal judge's eleventh-hour decision to stay the rule until August. Judge Scott Skavdahl, of the U.S. District Court for the District of Wyoming, issued the decision after more than six hours of courtroom arguments yesterday in Casper, where attorneys representing the oil and gas industry and affected states pushed for a preliminary injunction of the rule.

    A global agreement to curb greenhouse gas emissions would prevent nearly 70,000 premature American deaths annually by the end of the century while sparing the country hundreds of billions of dollars’ worth of economic losses, according to a major government study on the cost of climate change.
