    Just announced — Richard J. Pierce, will keynote the EBA Mid-Year Meeting & Conference
    EBA
    Richard J. Pierce, Professor of Law, George Washington University Law School is the most frequently cited scholar in the country in the field of administrative law and government regulation. He is a member of the Administrative Conference of the United States, and is the author or co-author of Administrative Law Treatise (5th ed. 2010) and Administrative Law & Process (5th ed. 2009), as well as numerous other books and over 120 articles on government regulation, regulatory economics, and the effects of various forms of government intervention on the performance of markets. Please plan to join us on November 17-18th in Washington, DC for the conference and Professor Pierce’s address.

    Climate fight shifts to courts
    The Hill
    States, energy companies and business groups are preparing to sue the Obama administration over its new climate rule, viewing it as their best shot at stopping the regulations while President Obama is still in office. With Congress largely powerless to stop the rule, opponents of Obama’s push say the court system is their only hope at beating back the carbon limits until a new president takes over the Oval Office in 2017.

    The other death spiral utilities are beginning to deal with

    The central lesson for utilities in the talk of a death spiral is if they don’t give their customers what they want, they go elsewhere. To date, that talk is mostly about rooftop solar taking their revenues, but some utilities have begun to notice some of their biggest key accounts looking for greener pastures. Well, greener energy. "This is a new environment. You don’t just build it and shove it in the rate base. There is a more open dialogue. Renewable energy is at the center of that," explained Altenex Managing Director Duncan McIntyre.

    Obama rule adds 'safety valve' for grid emergencies

    Faced with warnings of possible grid blackouts tied to future coal plant closings, U.S. EPA added a reliability "safety valve" to its final Clean Power Plan that gives states a 90-day period to exceed carbon limits during emergencies. U.S. EPA air chief Janet McCabe said, however, that her agency expects that regulatory relief for reliability purposes will be a rarity.

    Infant US wave-to-energy industry looks to build more testing facilities

    In the wave energy world, progress means having "steel in the water." Now that gadgets are graduating from mere prototypes to pre-commercial machines, their engineers must find the best places to try them out in the open ocean. "You can learn a lot in the lab, but in order to prove commercial viability, you need to prove ocean viability," said Justin Klure, a partner at Portland, Oregon-based Pacific Energy Ventures, who consults on the Azura wave energy device.
