    INDUSTRY HIGHLIGHTS

    Commission Denies Pepco/Exelon Merger Application
    FERC
On Aug. 25, the Public Service Commission of the District of Columbia ("Commission") voted to deny an application for acquisition of Pepco Holdings, Inc. (PHI) by Exelon Corporation as not being in the public interest. In determining whether the Proposed Merger is in the public interest pursuant to D.C. Code §§ 34-504 and 34-1001, the Commission first considered the effect of the Proposed Merger transaction on each of the seven public interest factors. This included the effects of the transaction on ratepayers and shareholders, on competition in the local retail and wholesale markets and on conservation of natural resources and preservation of environmental quality.

The working group that produced the paper could easily have been adversarial but there was a surprising amount of accord, the executive who helped lead the process told Utility Dive.

    FierceEnergy
Alaska is getting a lot of attention in the energy industry, partially because U.S. Senator Lisa Murkowski, from Alaska, is now the Chairman of the U.S. Senate Committee on Energy and Natural Resources. Judge upholds denial of rate increase to recover utility revenues lost to efficiency
    Utility Dive
A Montana district court judge has ruled to uphold an order from the state Public Service Commission (PSC) to deny NorthWestern Energy a proposed rate increase to recover lost revenues, The Associated Press reports. Northwestern sought the rate increase to recover the costs of unexpected outages and lost revenues due to energy efficiency programs. The judge found the PSC rejected the rate hike "based on substantive evidence and by doing so ensured reasonable and just rates," according to the AP.
