    Energy Law Journal: Minimizing Risk Under the Clean Water Act

    The current issue of the Energy Law Journal contains a useful article for companies that have to navigate the complexities of the Clean Water Act entitled "Minimizing Risk Under the Clean Water Act." A team of lawyers from WilmerHale, Carol Clayton, H. David Gold, Brent Gurney, Mark Kalpin and Alexander White, provide an in-depth approach for energy companies to minimize their exposure to Clean Water Act regulatory enforcement actions by implementing strong compliance programs. They contend that meeting regulatory requirements and permit conditions is not enough. According to the authors, energy companies should also have strong risk management programs designed to prevent accidental releases of oil and hazardous substances, as well as emergency preparedness and response plans that enable them to minimize the impacts of any release. Should a regulatory violation or accidental release nonetheless occur, the authors suggest that energy companies may persuade the government to forgo criminal enforcement and accept reduced civil penalties by taking steps spelled out in federal enforcement policies and guidelines, such as prompt reporting, remediation and implementing corrective measures to prevent a recurrence.

    Locational Marginal Prices – Foundations and Frontiers
