    Did you attend the previous Annual Meeting and/or Mid-Year Meeting and feel as if a topic was missing? If so, please take a moment to click on the survey link below and submit a short paragraph proposing a topic of interest on or before December 22, 2014. If you have time, include in your submission a sentence explaining the types of speakers (attorneys, business persons, consultants, etc.) you would like to see on a panel or as a keynote.

    The Committee looks forward to reviewing your ideas and will consider all suggestions in our planning for the EBA year. In the likely event that we are unable to accommodate all topics of interest in our national meeting programming, we will be sure to forward your ideas on to the leadership of other EBA committees and chapters for consideration in their program planning for the year.

    EBA Primer Series: An Introduction to Federal Oil Pipeline Regulation

    EBA will hold its fourth program in the EBA Primer Series…An Introduction to Federal Oil Pipeline Regulation in Houston, TX on January 26-27, 2015. The goal of this primer is to provide an overview of the federal economic regulation of oil and refined products pipelines. Taught by industry practitioners and regulators from the Federal Energy Regulatory Commission, the course begins with a brief overview of the oil and refined products pipeline industry and then describes key statutes and regulations governing and affecting the transportation of oil and other liquid petroleum products. Instructors explain important legal and regulatory concepts and requirements, pipeline services, the scope and limits of FERC and state jurisdiction and key issues affecting the industry.     Industry, enviros dissect mess of litigation as year closes

    Ask lawyers their biggest fear, and most will say uncertainty. The past year of sprawling oil and gas litigation delivered just that: an unsettled scorecard that ensures only a slew of new lawsuits to come. On litigious issues ranging from contract disputes to regulatory compliance to environmental concerns, attorneys from both industry and the environmental community are having a tough time saying who came out ahead. Though certain 2014 decisions delivered emphatic legal victories for each side, the collective result is a mixed bag for stakeholders to sort through — all with high-stakes implications for policy, property and investments.

    FERC wades into reliability fight over EPA's Clean Power Plan

    Federal regulators are planning a series of technical conferences beginning in February to weigh the consequences of state and industry efforts to comply with U.S. EPA's controversial proposal to curb carbon dioxide emissions from power plants. The move announced yesterday by Federal Energy Regulatory Commission Chairwoman Cheryl LaFleur is responsive to calls by Congress, her fellow commissioners and electricity industry stakeholders who have raised concerns about whether compliance with the EPA Clean Power Plan as proposed will endanger grid reliability or adversely affect regional wholesale electric markets.

    OPEC isn't scared of $40 oil

    OPEC won't rush to cut oil production even if prices fall as low as $40 per barrel, one of the cartel's members said Dec. 14. The energy minister for the United Arab Emirates told Bloomberg at a Dubai conference that the middle eastern oil producers believe "the market will stabilize itself." "We are not going to change our minds because the prices went to $60 or to $40," SuhailAl-Mazrouei said. Even as it has watched prices dip, OPEC declined to cut back on production at its November meeting. Some observers had expected a production cut to boost the price of crude.

    EU dings Austria, Poland over green energy laws

    The lower EU court ruled that Austria's scheme to cap the price of renewable energy for energy-hogging businesses is illegal state aid, while an advisor to the high court dinged Poland for not implementing Europe's renewable-energy law at all in a pair of opinions issued Dec. 11. Under the Renewable Energy Directive passed in 2009, European member states must achieve mandatory national targets for renewable energy by 2020. While the law set the targets for each nation, member states can choose how to meet their objectives.

    Getting Distributed Generation Right: A Response To "Does Disruptive Competition Mean a Death Spiral For Electric Utilities?"

    The current issue of the Energy Law Journal presents another view point on the public debate surrounding a potential utility “death spiral” that some claim will result from competition brought on by distributed generation. Check out the article by Washington lawyer, David Raskin, Getting Distributed Generation Right: A Response To "Does Disruptive Competition Mean A Death Spiral For Electric Utilities?", in response to a recent Energy Law Journal article by Elisabeth Graffy and Steven Kihm, which claimed that the electric utility industry faces a mortal threat in the near future from distributed generation and other emerging technologies that will allow customers to bypass the electric grid. Mr. Raskin contends that the authors of that article overstate their predictions that utilities will be unable to recover in regulated rates investments stranded by new distributed generation competition. Mr. Raskin contends that no realistic substitute for reliable electric service from the utility grid currently exists, and distributed technologies would have to make remarkable gains to become a substitute. Even if distributed alternatives continue to grow, Mr. Raskin suggests that much of the public will rely on utility service for many decades, and the utility industry will continue to need access to capital and operating funds to provide this service. Finally, he concludes that the growth of alternatives to utility-supplied electric service may, over time, present a challenge to regulators and the utility industry, but the challenge will be much more complex than the authors recognize and will involve issues of fairness between those who rely on the grid entirely, those who use it for some unbundled services, and those who eventually are able to fully disconnect.
