Legislative update: Second time around; DHS back on Capitol Hill over CFATS program problems Share
Rand Beers, undersecretary of the National Protection and Programs Directorate at the Department of Homeland Security, and Penny J. Anderson, DHS director with responsibility over the Chemical Facilities Anti-Terrorism Standards program, testified before the U.S. House Committee on Homeland Security Subcommittee on Cybersecurity, Infrastructure Protection, and Security Technologies on Tuesday, March 6. This follows a similar hearing held by the Energy and Commerce Environment and the Economy Subcommittee in February. Beers and Anderson again addressed concerns in response to an internal DHS report detailing CFATS program problems that was leaked and reported on by Fox News in late 2011. The U.S. Environmental Protection Agency Office of Pollution Prevention and Toxics previously announced a work plan for 83 chemicals for review under the Toxic Substances Control Act. These chemicals will be subject to risk assessments over the next several years. EPA has selected seven chemicals or groups of chemicals for assessments in 2012. More
Regulatory update: EPA proposes mandatory electronic filing for TRI reports Share
On March 5, the U.S. Environmental Protection Agency published a proposed rule in the Federal Register to require facilities to file Toxics Release Inventory reports electronically. Under the proposal, as of Jan. 1, 2013, facilities must report non-confidential TRI data to EPA using electronic software provided by the agency. Comments are due to EPA by May 4, 2012. On Friday, March 2 the Federal District Court in Washington, D.C. issued a decision on the challenge to the National Labor Relations Board notice postings rule in the case brought against the NLRB by the Coalition for a Democratic Workplace. NACD is a member of the CDW. The decision upheld the NLRB requirement that businesses must post the notice by April 30, informing employees of their rights to form labor unions, but imposed some procedural limits on the NLRB's authority to penalize employers for not doing so. US and Canada working together on GHS alignment Chemical Watch Share
The U.S. and Canada are working together in an effort to ensure consistent implementation of the Globally Harmonized System of classification and labeling of chemicals. Maureen Ruskin, director of the Office of Chemical Hazards at the Occupational Health and Safety Administration, said that the U.S. and Canada had formed a regulatory coordination council and GHS implementation had been included in the current work plan. The trucking industry increased hiring 3.7 percent year-over-year in February, a slower pace than in January, according to the Bureau of Labor Statistics. Trucking employers increased hiring 4.1 percent in January from a year ago, and 3.7 percent year-over-year in December, according to seasonally adjusted data. The trend in the BLS payroll numbers reflects a trucking industry that spent 2011 trying to rebuild a work force decimated during the recession. Truck drivers, in particular, have been difficult to hire, according to motor carriers. That puts a limit on how quickly carriers can add capacity as demand rises. More
Intermodal volume on US railroads climbs 6 percent The Journal of Commerce Share
Intermodal volume hauled by major U.S. railroads rose 6 percent year-over-year in the week ending March 3, pushing intermodal traffic to the third highest ever in February, according to the Association of American Railroads. "Intermodal traffic was up for the 27th straight month, while carloads of a wide range of commodities — lumber, chemicals, petroleum, paper, steel and more — saw increases in February," said AAR Senior Vice President John T.
