No-vending zones get defeated in El Paso, Texas

The Institute for Justice won a big victory for mobile vendors in El Paso, Texas by having a protectionist zoning restriction repealed after filing lawsuits challenging their constitutionality. Street vendors had to conduct business outside of a thousand-yard zone where any other restaurants operated, a scheme that the city admitted had no basis in safety or health concerns. The local restaurant association pushed for the zoning restrictions as a way to protect their businesses, and the city responded by virtually outlawing mobile vendors from operating where potential consumers are.

Apparently, more people will hydrate this summer in the heat using bottled water than in 2008 and 2009. The International Bottled Water Association (IBWA) is reporting that consumption of bottled water rose by 3.5 percent in 2010, a phenomenon it pins to the general turnaround in the economy. Overall, bottled water accounts for approximately 30 percent of the "liquid refreshment beverages" marketplace. That's up slightly from the share in 2009, according to the statistics compiled by IBWA in conjunction with Beverage Marketing Corp. More
