Jackson Walker wins another dismissal under Texas anti-SLAPP law

The media outlet victories keep coming for the Citizens' Participation Act, commonly referred to as the anti-SLAPP lawsuit statute. Judge Jaclanel McFarland of the 133rd District Court for Harris County granted a motion to dismiss under the Texas anti-SLAPP law in March for Manzoor Memon, publisher of a Houston newspaper, against Syed Bukhari, who sued claiming that Memon had published defamatory statements about him.

US Supreme Court contemplates review of Texas Open Meetings Act suit

The federal lawsuit challenging the constitutionality of the Texas Open Meetings Act could be taken up by the U.S. Supreme Court later this year. Plaintiffs in the case have filed a petition for Writ of Certiorari with the Court to hear the case. The Court will consider the petition at its March 22 conference. (TAB members only.)

FCC gives nod to nationwide TV white-space database operation

Unlicensed transmitting devices operating in unused portions of the TV band got the go-ahead for nationwide operation when the FCC Office of Engineering and Technology authorized TV white-space database systems for use throughout the United States, its territories and possessions.

Pay attention: FCC will fine for expired nonbroadcast license

Both radio and TV broadcasters either recently have completed the license renewal process or will be doing so in the next few years. Many broadcasters think that once their broadcast licenses are renewed so too are all of the other communications licenses that are operated in connection with their station. While that may be true for broadcast auxiliary licenses, like Studio Transmitter Links and Remote Pickups, there are other FCC authorizations that are not covered by the broadcast license renewal process, and are also not covered by the applications on FCC Forms 314 and 315 for the sale of a broadcast station. If a broadcaster does not pay attention to the expiration dates for these nonbroadcast licenses, a hefty fine from FCC may occur.

Beyond just getting a seat at the table, digital buyers suddenly are finding themselves at its head — and the love of data, optimization and acronyms they're bringing with them could seriously shake up traditional media buying where a steak and a handshake still rule. Indeed, a growing number of agency media executives who grew up in digital are finding themselves overseeing the buying and planning of all media. These executives aren't looking to force all of TV and magazine buying onto real-time exchanges tomorrow. But it's clear they're modifying their old-school colleagues' ways of working and thinking — albeit nice and slowly.

FCC reduces station filing burden for 2013 EEO audits

As we all know, it's easy to complain about the Federal Government these days given the gridlock that currently exists on Capitol Hill, the Sequester, and the looming debt ceiling battle. But let's give credit where credit is due. The FCC has revised its Equal Employment Opportunity (EEO) audit letter for all broadcast licensees, and has eased the burden on respondents by eliminating the need to produce copies of each and every job vacancy notice that was sent out to every referral source, allowing stations instead to file only a representative copy of each job opening notice along with a list of the referral sources to which it was sent.

Ex-TV reporter Dolcefino seeks Katy school board seat

Former KTRK-TV, Channel 13, reporter Wayne Dolcefino, longtime scourge of public officials in his role as Channel 13's "Undercover" investigative reporter, is throwing his hat in the ring as a school board candidate in Katy. Dolcefino has filed as a candidate for the Katy Independent School Board position held by four-time chairman Joe Adams, a member of the board since 1989.

AP adopts stylebook mental health guidelines

The Associated Press released new AP Stylebook guidelines for reporters covering mental health issues. These new guidelines were developed with the support of NAB and others in the entertainment industry following recent tragedies such as the Newtown, Conn., school shootings and a renewed national dialogue on mental health.

FCC fines Texas station owner $6k for failing to change ownership information

The FCC has issued a $6,000 Notice of Apparent Liability for Forfeiture to Paulino Bernal, owner of antenna structure number 1066001, located in Tulia. The FCC said Bernal apparently "willfully and repeatedly violated Section 17.57 of the Commission's rules by failing to notify the Commission upon a change in ownership information for the antenna structure."
