Satellite bill morphs into Pay-TV Christmas tree

With every conceivable Pay-TV goodie dangling on its branches, the latest iteration of the STELA reauthorization has become nothing more than a fulfillment of the Pay-TV industry's every Christmas wish, with the end result being the decimation of the retransmission consent process and, eventually, broadcast TV localism. As expected, Senate Commerce Committee Chairman John D. Rockefeller, IV, D-W. Va., has rolled out a proposed five-year renewal of the satellite TV bill that includes not only an ill-conceived broadcast-only a la carte plan, but additional harmful provisions that have been rejected by other key Congressional committees

Abbott, Davis agree to new Sept. 30 gubernatorial broadcast debate
KERA
KERA, the North Texas public television and radio stations, will host Attorney General Greg Abbott and State Sen. Wendy Davis in The Texas Debates: The Race for Governor. The one-hour live debate is a co-production with NBC 5/KXAS-TV, Telemundo 39/KXTX-TV and The Dallas Morning News. It will broadcast at 8 p.m. CDT on Sept. 30 on television, radio and online.

This month's 90-minute webinar on the FCC's political broadcast rules has been posted to TAB's online video archive. Attorney Gregg Skall with TAB Associate Member law firm Womble Carlyle Sandridge & Rice LLP presented the session on Sept. 4 just in time for the opening of the fall FCC political window. FCC moves quickly to reject political ad sponsorship ID complaints

Broadcasters let out a small sigh of relief when the FCC made clear there is no requirement that TV stations have private investigators on staff. With TV stations' political files now available online, three political activist organizations have been jointly filing complaints against TV stations alleging various errors and omissions in online public file paperwork relating to political ad buys by third-party advertisers.

FCC sets Sept. 23 deadline for 2014 Annual Regulatory Fees

Normally, the FCC releases an order adopting the official fee amounts and the deadline by which they must be filed in early to mid-August of each year. This year, however, licensees were beginning to get nervous, as August was coming to a close and there still had been no word from the FCC as to the final fee amounts and how quickly they must be paid. Fortunately, the FCC was able to get the fee order out on the last business day of August. Unfortunately, because the Public Notice of the release occurred on a Friday before a three-day weekend, many licensees may miss that announcement.

Issue-oriented political spots: Who's the real sponsor?

Several months ago, CommLawBlog reported on complaints filed against a dozen or so TV stations with respect to the stations' alleged failure to include in their online political files all of the various detailed information required by applicable political advertising laws. It was expected that it was just an opening salvo. Turns out, it did. The same two complainants have since filed a couple more, based not on the political rules, but rather on the more general sponsorship identification requirements of Section 317 of the Communications Act.

Texas Supreme Court voids order to reveal blogger's identity

An Ohio company seeking to sue a sharply critical blogger who wrote under a pseudonym, cannot use the Texas courts to discover the online author's identity, a divided Texas Supreme Court ruled. The 5-4 decision voided a Harris County district judge's ruling that ordered Google Inc., which operated the blog's online home, to disclose the blogger's name and address so the company would know who to sue for defamation and business disparagement.
