With election over, state lawmakers get jump on legislative session
-Slow start anticipated, special session possible

As the last particles of dust from the General Election settled, state lawmakers on Monday began pre-filing bills for consideration in the upcoming legislative session which begins Tuesday, Jan. 13. Pre-filed bills typically get a lot of attention, but they rarely figure heavily in the ultimate legislative agenda. Most major policy initiatives are filed weeks after legislators convene, with the bill filing deadline set for the 60th day of the session, Friday, March 13. The 140-day session adjourns Monday, June 1.

RTDNA, other media groups dispute need for 'no-fly' zone in Ferguson, Missouri

The Radio Television Digital News Association released a letter sent to the Federal Aviation Administration regarding the Temporary Flight Restriction set up in the wake of the Michael Brown shooting in Ferguson, Missouri, in August. In the letter dated Nov. 3, RTDNA Executive Director Mike Cavender, references an Associated Press story showing that "public safety was not a concern in the decision to keep media helicopters" from flying over the scene.

Save or delete? Government email retention policies vary by state

In Pennsylvania, state agency employees' email is purged five days after it is deleted. In New York, email is automatically discarded after 90 days unless an employee specifically tags it. And in North Carolina, executive branch email of any kind must be kept for at least five years. Every state has policies governing how long records are saved and when they can be purged — if ever. But those retention policies vary greatly across states. Often employees have to determine on their own whether to keep or delete an email.

FCC requires TV JSAs be filed by Nov. 28, releases guide to filing obligations

In April, the FCC determined that TV Joint Sales Agreements, by which the owner of one TV station in a market sells more than 15 percent of the advertising time on another station in the same market, are "attributable interests" under the multiple ownership rules. The FCC gave stations involved in existing JSAs two years to undo current agreements and the decision is on appeal by the NAB and other affected broadcasters. Nevertheless, the filing requirement has now passed review by the Office of Management and Budget under the Paperwork Reduction Act, and the FCC announced that the obligation to submit existing JSAs to the Commission will be effective Nov. 28.

Court preliminarily approves TVMLC-SESAC settlement

If you're a full-power TV licensee, in the near future you can expect to be receiving a note from the Television Music License Committee notifying you that a court has preliminarily approved a settlement the Committee has reached with SESAC. You have the option of objecting to the settlement or opting out of it, but if you do neither, you'll be bound by its terms — unless you happen to be Univision or Telefutura, in which case you're not part of the Settlement Class.
