However, the state of Wisconsin, particularly its Department of Transportation, can’t afford to continue to sit on the sidelines while the rest of nation delivers collaborative, innovative and efficient design-build infrastructure projects each and every day. It’s hard for me to imagine why anyone believes Wisconsin is incapable of doing what 47 other states in the nation and the Feds do with great success. There’s no doubt that the small, yet vocal, group opposed to change in Wisconsin has portrayed the adoption of design-build as a virtual Armageddon for the state’s contractors and good governance.

With groundwater supplies in dwindling supply and questionable quality, members of the Stanislaus Regional Water Authority (SRWA) acted formally on Thursday to start the process of building a plant to deliver treated Tuolumne River water to homes in Ceres and Turlock by 2022. ... The SRWA recently lobbied for passage of special legislation in SB 373 which enables the agency to construct the plant using a design-build delivery method. Such a method enables the plant to be built faster and cheaper than the alternative.

The U.S. Department of Transportation (U.S. DOT) is writing a new rule aimed at encouraging more private sector investment in public transportation projects.
The U.S. economy continued a strong summer, adding 209,000 jobs in July while the unemployment rate fell to 4.3 percent, the lowest since March 2001, according to a government report Friday.
Leidos is seeking interested bidders for the Antarctic Infrastructure and Modernization for Science (AIMS) project, with an RFP anticipated in October. As part of the timetable for removal, WSDOT plans to send out a request for qualifications for contractors and develop a request for proposals this summer. Late in 2017, WSDOT expects to issue a RFP to the most qualified contractors, with proposals due in early 2018 and the contract awarded to the best-value contractor shortly thereafter. The best-value approach incudes a design-build contracting method that WSDOT says encourages “innovative and cost-effective proposals.” By giving contractors greater flexibility, WSDOT hopes to lean on the expertise and experience of the contractors.
Minnesota has also stepped up and improved bridge inspections, and now even uses drones sometimes to take photos and video of spots on bridges that are difficult for human inspectors to reach.
The state now gets outside independent peer reviews of bridge design plans, and it's revamped its bridge maintenance worker training program.
Dallas-based Jacobs Engineering Group is making moves to garner more government and infrastructure work, with its plans to buy the Englewood, CO-based CH2M Hill Cos., according to The Wall Street Journal. The deal is expected to close by the end of this year.

Work on the CSB proposal began in 2012 when Council authorized a three step (study, design, build) approach for project. In 2014 Council approved the first step and selected Hathaway Dinwiddie Construction Company for the feasibility analysis, concept design and cost estimates. In 2015, Council chose to design a building that would achieve the Living Building Challenge and finished the second step with the approval of $7,064,501 to design the building.

Two recent Indiana decisions highlight the importance of understanding the terms of your construction contracts, ensuring they are consistent with your insurance policies, and that they comply with the law of your jurisdiction. Simply using form contracts or recycling contract provisions without tailoring them to your specific project can have unintended consequences, and can create insurance coverage gaps.
Performance bonds, as the name plainly states, are issued to guarantee performance. If a contractor doesn’t perform its obligations, the surety must complete the work or pay the owner to do so. But what happens if the contractor completes its work? Is the surety discharged? Not necessarily. Owners frequently make warranty and latent defect claims against performance bonds. This article discusses the primary post-completion defenses available to a surety: waiver, expiration of the contractual or statutory limitations period, and failure to satisfy conditions precedent. This article also provides some practical guidance for owners and other performance bond beneficiaries to avoid a surety’s post-completion defenses.

Silicon Valley Clean Water (SVCW) will be initiating a selection process for the lump sum design build (DB) for the Treatment Plant Reliability Improvements Project (capital budget of
$5,000,000). SVCW is a regional joint powers authority in the San Francisco Bay Area region of California, serving the cities of Belmont, Redwood City, San Carlos, and West Bay Sanitary
District. SVCW is undertaking improvements to the wastewater treatment plant via a multiyear CIP to address aging systems and improve reliability.
