Tell any students, professors or friends that registration for the 2016 National Design-Build Student Competition is now open until Sept. 2, 2016. The two-phase competition brings together teams consisting of five students from diverse fields of study (two students must be from a design or architecture program) collaborating on Request for Qualifications (RFQ) for a parking facility on a liberal arts college campus in the United States. Finalists will then respond to a Request for Proposal (RFP) and the top three shortlisted teams will present in person at DBIA's Annual Conference in Las Vegas. The Design-Build Institute of America (DBIA) and the Society of American Military Engineers (SAME) recently released a report detailing things that work well, challenges, and proposed solutions in federal project delivery from the perspective of owners.

Two New Jersey counties have filed notice they may sue the Christie administration for freezing promised funding for local road projects as the governor and Democratic legislative leaders tangle over transportation funding. Union and Hudson counties this month submitted "notices of claim" against the state, which serve as a threat that a lawsuit may be forthcoming. The counties argue the statewide idling of projects supported by the depleted Transportation Trust Fund will cost them untold sums.
When Illinois voters head to the polls in November, their first ballot question won’t involve U.S. presidential candidates, but a measure aimed at preventing transportation-related funding in the state from being used for other purposes.

Rush spent months consulting with industry experts on a project delivery system known as design-build, a process he was familiar with from his years working in commercial construction. With design-build, all architectural design and construction services are single-sourced through one contractor whose team works in close collaboration with the client throughout the project. The more traditional (and time-consuming) option is design-bid-build, where an architect is hired to design plans and those plans are put out for bid by a separate build contractor. Design-build can shave a year off a project from inception to completion.

New York State Department of Transportation Commissioner Matthew Driscoll has announced that a new roundabout will be opened early this fall on the southern approach of the Rexford Bridge, marking significant progress on the $32.5 million replacement of the busy two-lane bridge over the Mohawk River between the towns of Clifton Park in Saratoga County and Niskayuna in Schenectady County. Tioga Construction Co., Inc., of Utica and AECOM USA, Inc., of New York City are the best-value contractors for this design-build project.

Balfour Beatty has won its largest-ever US contract. It will carry out the $697m electrification of the 52 mile Caltrain rail corridor between San Francisco and San Jose, in preparation for the future operation of high-speed trains. The Peninsula Corridor Joint Powers Board awarded the contract to Balfour Beatty as part of the Caltrain Peninsula Corridor Electrification Project. The electrification will bring cleaner, high-performance electric vehicles to Caltrain's fleet, allowing for a more frequent service.

Contractors doing work on publicly-owned projects in Pennsylvania may find it more difficult to recover statutory penalties and attorneys’ fees if the owner withholds funds in bad faith. Pennsylvania’s Procurement Code, which governs bidding on public projects and payment to prime contractors and subcontractors, is intended to “level the playing field” between government and contractor.
According to the 2016 Energy Efficiency Indicator (EEI) Survey published by Johnson Controls, 85 percent of respondents across regions surveyed indicated that their organizations are paying considerably more attention to energy efficiency, with 72 percent planning to increase investments in this capacity and in renewable energy. Often what project teams fail to realize when incorporating energy efficient technology and strategies into building schematics is that they are already on the cusp of developing a zero-energy building.

The term “due diligence” is an overused expression in the compliance world. It has become a term to mean heightened concern or investigation. No one can really define what it means except to say it has different meanings in different contexts. Some would say it is a term of art in the legal and compliance world. It is misleading to add the term “investigation” to due diligence, suggesting that a due diligence investigation is something different than conducting due diligence alone.
When it comes to third party corruption risk, it is time to retire the term “due diligence.” Besides the definitional concerns, there is a substantive reason for a new approach.

There is less than a week left to apply for an owner scholarship to the 2016 Design-Build Conference & Expo being held this November 2-4 in Las Vegas. The goal of the Owner Scholarship Funds is to advance the awareness, understanding and use of design-build among as many owners/government agencies as possible. Any public owner of construction projects is eligible, as long as they are considering, or interested in considering, the use of design-build as a project delivery method, or have utilized this project delivery method in the past.
