Metcalf v. U.S.: What Does It Mean for Design-Build and Federal Contractors?

From June 19, 2014: The United States Federal Court of Claims decision in Metcalf v. U.S., 107 Fed. Cl. 786 (2012), dramatically altered the risk for differing site conditions in a design-build project, which is why DBIA led the charge to urge the Court of Appeals for the Federal Circuit to overturn the decision. The conduct of the naval Facilities Engineering Command (NAVFAC) during the project at issue in the Metcalf decision was certainly concerning to the construction industry.

Hawaii Contractor Metcalf Construction Wins Appeal in Federal Contracting Lawsuit

From Feb. 27, 2014: Hawaii-based Metcalf Construction Co. has won a key reversal from a federal appeals court in a case involving failures by the federal government to properly administer a contract for work, which could have broad implications for the rest of the government contracting community.

Court Decision Good for Design-Builders

From Feb. 20, 2014: On Feb. 11, the Court of Appeals for the Federal Circuit issued a major opinion overturning the Court of Federal Claims opinion in Metcalf v. US. The ruling that was overturned had such broad, negative implications for the construction industry that DBIA, AIA, AGC and ABC all submitted amicus or “friend of the court” briefs urging that the case be overturned. The two primary issues in the lower court’s ruling were its interpretation of the differing site conditions clause in the Federal Acquisition Regulations and its interpretation of the covenant of good faith and fair dealing, implied in every Federal contract.

DBIA Announces 2014 Design-Build Project/Team Award Winners

From Aug. 7, 2014: DBIA has announced its 19th annual Design-Build Project/Team Award Winners. This year, 25 projects in nine categories were awarded National Awards of Merit for demonstrating advanced and innovative design-build project delivery, in addition to achieving budget and schedule goals and exceeding owner expectations. One project in each of the nine categories will be named as a National Award of Excellence winner in an awards ceremony during DBIA's Design-Build Conference and Expo on Oct. 7 in Dallas, Texas. In addition, three National Awards of Excellence will be given for Design, Process and Teaming. The Project of the Year winner will also be announced at the awards ceremony.

Which Huge Contractor Will Build MGM National Harbor in Maryland?

From March 20, 2014: MGM National Harbor has retained a handful of local companies to perform various tasks related to the future $925 million resort-casino, including an architect of record and project manager, but the big hire is still to come: general contractor. There are only so many firms that have the capacity and experience to handle a huge job like this, and several of those that appeared at a pre-bid conference for general contractors fit the bill.
