The National Association of Chemical Distributors (NACD) joined a coalition of 144 other industry associations in sending a letter to both the U.S. House of Representatives and the U.S. Senate encouraging lawmakers to support introduction and passage of bipartisan legislation to update the Toxic Substances Control Act (TSCA).

Proposition 65 May Mean More Than Warning Signs and Lawsuits

Recently, the California Office of Environmental Health Hazard Assessment (OEHHA), the lead agency for Proposition 65 implementation, has proposed new regulations to the Proposition 65 regiment. In addition to companies being exposed to potential lawsuits alleging the failure to comply with the regulations, as well as the alleged failure to warn about chemicals of concern, an issue for companies arises during the course of negotiating supply agreements.

EPA Issues SNUR for Long-Chain Perfluoroalkyl Carboxylate, Amends SNUR for Perfluoroalkyl Sulfonate

Under the Toxic Substances Control Act (TSCA), EPA is proposing to amend a significant new use rule (SNUR) for long-chain perfluoroalkyl carboxylate (LCPFAC) chemical substances by designating as a significant new use manufacturing (including importing) or processing of an identified subset of LCPFAC chemical substances for any use that will not be ongoing after Dece. 31, 2015, and all other LCPFAC chemicals substances for which there are currently no ongoing uses. For this SNUR, EPA is also proposing to make inapplicable the exemption for persons who import LCPFAC chemical substances as part of articles. In addition, EPA is also proposing to amend a SNUR for perfluoroalkyl sulfonate (PFAS) chemical substances that would make inapplicable the exemption for persons who import PFAS chemical substances as part of carpets.

European Watchdog Says BPA Plastics Chemical Poses No Health Risk

The chemical bisphenol A, used to stiffen some plastic food containers, poses no health risk to consumers of any age, including unborn children, at current levels of exposure, Europe's food safety watchdog said.

FMCSA Study: Crash Accountability Analysis Costly, Not Helpful to CSA

Even though 9 in 10 police accident reports (PARs) contain the type of information needed to determine fault in truck crashes, a study by the Federal Motor Carrier Safety Administration has concluded that incorporating such determinations would be time-consuming and expensive, and would not improve the agency's ability to identify those carriers most at risk of future accidents.

Hearing to Examine Freight Rail Transportation Challenges
The Senate Commerce, Science and Transportation Committee will examine freight rail transportation issues at a full committee hearing on Wednesday. Chairman John Thune (R-S.D.) told reporters the hearing would address challenges resulting from the growing demand for freight carriers to move oil, as well as explain some of the rail issues before Congress this year.

House Ways and Means to Hold Hearing on U.S. Trade Agenda
Today, the House of Representatives Committee on Ways and Means will hold a full committee hearing on the U.S. trade policy agenda. After testifying at the Senate Finance Committee earlier in the day, U.S. Trade Representative Michael Froman is scheduled to testify on the president's request for fast-track negotiating power, or trade promotion authority (TPA), which some Democrats oppose. Giving President Barack Obama TPA would allow Congress only an up-or-down vote on the Trans-Pacific Partnership and other trade agreements. A TPA bill is expected to be introduced next month.

Senate Sets Final Keystone Vote This Week
The Senate is still working its way through amendments to a bill approving construction of the Keystone XL pipeline. Republicans and Democrats got into an ugly dispute late Thursday night when they couldn't reach an agreement on which amendments should get votes. McConnell filed for cloture on the underlying bill, setting up a final vote on Keystone this week.

Lawmaker: Congress May Take Action on FMCSA Opening Mexican Border

As of mid-January, any Mexican carrier domiciled on the other side of the border can apply for authority to operate in the U.S. outside of the commercial border zone — a privilege previously reserved only for Mexican carriers admitted to the DOT's cross-border trucking pilot program. Opening the U.S. border for Mexican carriers, however, likely won't be without challenges.
