    NACD Applauds Toxic Substances Control Act Reform Legislation
    Today, NACD welcomed the bipartisan introduction in the U.S. Senate of the Frank R. Lautenberg Chemical Safety for the 21st Century Act, a bill that proposes substantial reforms to the nearly 40-year-old Toxic Substances Control Act. Sponsored by Senators David Vitter (R-LA) and Tom Udall (D-NM), the legislation aims to make significant improvements to the way chemicals are evaluated for safety and establish a federal standard regarding the treatment of chemicals.

    NACD will host a webinar in the coming weeks during which the U.S. Occupational Safety and Health Administration's (OSHA) enforcement staff will review the recently published "Enforcement Guidance for the Hazard Communication Standard's (HCS) June 1, 2015, Effective Date" (Guidance) and answer questions.     Colorado Plant Fined Six Figures for RMP and EPCRA Violations
    U.S. Environmental Protection Agency
    Last week, the U.S. Environmental Protection Agency (EPA) announced that Western Operating Company has agreed to pay $122,900 in penalties to resolve alleged violations of the Clean Air Act (CAA) and the Emergency Planning and Community Right-to-Know Act (EPCRA) at its plant in Morgan County, Colorado. The agreement resolves alleged violations of the risk management planning (RMP) requirements of the CAA and the hazardous chemical inventory reporting requirements under EPCRA.

    White House Taps Transportation Official to Head Chemical Safety Board
    Chemical & Engineering News
    President Barack Obama planned to nominate a Department of Transportation lawyer to become the next chair of the Chemical Safety & Hazard Investigation Board (CSB), the White House announced March 3. If confirmed, Vanessa Allen Sutherland, chief counsel for the Pipeline & Hazardous Materials Safety Administration since October 2011, would replace CSB Chairman Rafael Moure-Eraso, whose five-year term expires in June.

    FMCSA Alters Course on E-Log Mandate, Moves Up Publication Date

    EPA Issues Enforcement Alert on Anhydrous Ammonia and RMP
    U.S. Environmental Protection Agency
    The U.S. Environmental Protection Agency (EPA) recently published an enforcement alert on Clean Air Act Risk Management Program requirements for anhydrous ammonia. The alert focuses on refrigeration facilities but includes useful information for all RMP-regulated facilities, including a reminder that EPA will not hesitate to use the General Duty Clause to cite facilities.

    EPA Issues Final SNUR for Industrial Solvent
    On Friday, March 6, the U.S. Environmental Protection Agency (EPA) published a final significant new use rule (SNUR) under the Toxic Substances Control Act (TSCA) for the chemical substance Pentane, 1,1,1,2,3,3-hexafluoro-4-(1,1,2,3,3,3-hexafluoropropoxy), a chemical used in petroleum refining. The substance was the subject of premanufacture notice (PMN) P-07-204.

    EPA Extends Comment Period for 13 Proposed Significant New Use Rules
    U.S. Environmental Protection Agency
    EPA issued a proposed rule in the Federal Register of Jan. 7, 2015, concerning proposed significant new use rules for 13 chemical substances that were the subject of premanufacture notices (PMNs). This document extends the comment period for 45 days, from March 9, 2015, to April 23, 2015.

    EPA Launches 'Safer Choice' Label Program to Replace 'Design for the Environment'

    The Environmental Protection Agency (EPA) is overhauling its voluntary labeling system for designating that household cleaners and contain environmentally safe ingredients. The "Safer Choice" system is the new iteration of its "Design for the Environment" labels, meant to certify products that are safe for the environment, pets, children and adults.
