Regulatory update: DOT issues proposal on loading and unloading procedures

The U.S. Department of Transportation Pipeline and Hazardous Materials Safety Administration has published a proposed rule in the Federal Register to require facilities and carriers that engage in cargo tank loading or unloading to establish safe operating procedures. Specifically, each carrier or facility would be required to perform a risk assessment of its cargo tank loading and unloading operations and develop safe operating procedures based on the results of this assessment. Legislative update: Senator introduces bill to reinstate superfund taxes

Senator Frank Lautenberg, D-N.J., chairman of the Superfund, Toxics and Environmental Health Subcommittee, has introduced S. 461, "The Polluter Pays Restoration Act," to reinstate the Superfund taxes that expired in 1995. The bill would reinstate the 9.7-cent per barrel tax on petroleum, a feedstocks excise tax on 42 chemicals and an "environmental income tax" of 0.12 percent for all corporations who have taxable income in excess of $2 million. More

Regulatory update: NACD signs brief on NLRB case involving union cherry picking

The Coalition for a Democratic Workforce filed a brief with the National Labor Relations Board on the case Specialty Health Care and Rehabilitation Center of Mobile and United Steelworkers, District 9. NACD was a signatory on the brief. If the union prevails, this case would substantially change the standard for determining an appropriate bargaining unit for all workplaces covered by the National Labor Relations Act. More

Freight Transportation Services Index rose 0.9 percent in January

The Freight Transportation Services Index (TSI) rose 0.9 percent in January from a revised December level, rising for the second consecutive month, the U.S. Department of Transportation's Bureau of Transportation Statistics (BTS) reported. BTS reported that this release includes a comprehensive, biannual revision that resulted in changes to monthly numbers released previously. The revised Freight TSI rose 14.6 percent over the last 21 months, starting in May 2009, after declining 16.8 percent in the previous 16 months beginning in January 2008. More

International chemical giant Dow reported minimal impact to its Japanese sites after a massive, 8.9-magnitude earthquake hit Japan's northeastern coast, triggering a tsunami. In a statement, Dow officials reported: "Early reports indicate that the impact to Dow people and sites is minimal. We do have reports of flooding at Dow's Soma facility, but no injuries or environmental incidents to report. Limited communication is currently hampering area inspection efforts, but we will continue to monitor the situation and provide updates as we learn more." More
