Legislative update: House subcommittee approves bill to extend CFATS Share ![]() ![]() ![]() ![]() The House Homeland Security Subcommittee on Cybersecurity, Infrastructure Protection, and Security Technologies has approved H.R. 901, the Chemical Facility Anti-Terrorism Security Authorization Act, to extend the authority of the Department of Homeland Security to regulate chemical facilities through September 30, 2018. NACD supports H.R. 901 because, like similar legislation, H.R. 908, which is pending in the House Energy & Commerce Committee, it would allow the Chemical Facility Anti-Terrorism Standards to be fully implemented and evaluated before changes are made to the program. Legislative update: Lautenberg reintroduces Safe Chemicals Act Share ![]() ![]() ![]()
Sen. Frank Lautenberg, D-N.J., introduced S. 847, the Safe Chemicals Act, which would amend the Toxic Substances Control Act to place the burden of proof on chemical manufacturers to demonstrate the safety of products before placing them on the market. S. 847 is an updated version of the TSCA reform bill that Lautenberg introduced last year. More
Regulatory update: NACD files comments on rail competition Share ![]() ![]() ![]()
NACD has submitted comments to the Surface Transportation Board in response to a notice from the agency asking interested parties to submit their views on the state of competition in the railroad industry. NACD's comments discussed the issue of captive customers, including chemical distributors, being subject to ever-increasing rates and poor service and the importance of access to affordable and dependable rail service for the chemical industry. The House Transportation and Infrastructure Subcommittee on Railroads, Pipelines and Hazardous Materials recently held a hearing entitled "Reducing Regulatory Burdens and Ensuring Safe Transportation of Hazardous Materials." The hearing focused on changes that have been made to the Department of Transportation's Special Permits & Approvals program over the past year that require applicants to submit additional non-safety related information and subjects applicants to safety fitness evaluations based on criteria that have not been made public. President Obama has signed into law legislation to repeal one of the most bureaucratic elements of the health care reform law, the requirement that businesses file a 1099 to the Internal Revenue Service for every purchase of $600 or more from a vendor. More
