Legislative update: House subcommittee approves chemical security extension

The Environment and the Economy Subcommittee of the House Energy and Commerce Committee approved H.R. 908, the full implementation of the Chemical Facility Anti-Terrorism Standards Act by voice vote. This bill would extend the CFATS program through Sept. 2017. In March, NACD Chairman Andrew Skipp testified before the same subcommittee in favor of H.R. 908. More

Regulatory update: FMCSA reopens HOS comment period to address new studies

The Federal Motor Carrier Safety Administration has published a notice in the Federal Register announcing the reopening of the comment period on the hours of service proposed rule. FMCSA is taking this action because four additional studies have been placed into the docket. Comments will only be accepted on these documents, and FMCSA will accept comments on the four new studies until June 8. More

Regulatory update: TSA publishes final rule on reporting of security issues

On April 22, the Transportation Security Administration published a final rule in the Federal Register on security issue reporting. Under the final rule, any person who reports to TSA a transportation security-related problem, deficiency or vulnerability, including the security of aviation, commercial motor vehicle, maritime, pipeline, any mode of public transportation or railroad transportation, will receive a receipt for their report if they provide valid contact information and report via U.S. mail, the Internet or by telephone. More

The Environmental Protection Agency Office of Inspector General has issued a report on the lack of timely progress on the agency's Endocrine Disruptor Screening Program (EDSP). The report notes that 14 years after enactment of the Food Quality Protection Act, which gave EPA authority to mandate testing, the agency has not determined whether any chemicals are potential endocrine disruptors. More

The Department of Homeland Security, acting on intelligence seized in the raid on Osama bin Laden's hideout, is warning states and other federal agencies that al Qaeda has been considering terror plots against the U.S. rail system, although the agency said there was no information suggesting an imminent threat. U.S. officials are bolstering security at potential infrastructure targets and considering new rules to strengthen security for cargo and passengers. More

EU agency sued for transparency on toxic chemicals

Two environmental groups said on Monday they had sued ECHA, Europe's chemicals watchdog, for withholding information about the production of toxic chemicals. The lawsuit, filed by activist lawyers ClientEarth and chemicals campaigners ChemSec, says the European Chemicals Agency breached transparency laws by refusing to disclose the names of facilities producing 356 potentially dangerous chemicals. More
