Regulatory Update: NACD asks PHMSA to withdraw closure instructions proposal

NACD has filed comments in opposition to a new closure instructions requirement included in an April 26 Pipeline and Hazardous Materials Safety Administration proposed rule, HM-218G, Hazardous Materials: Miscellaneous Amendments. The new closure provision would require shippers to provide detailed closure instructions to customers and would require customers to follow these instructions when shipping the containers after they are emptied. More



Regulatory Deadline Alert: TRI reports due to EPA this week

July 1 is the deadline for facilities to submit 2011 Toxic Release Inventory reports to the U.S. Environmental Protection Agency. Emergency Planning and Community Right to Know Act Section 313 (40 CFR Part 372) requires facilities, including chemical distributors, to annually report to EPA the manufacture, use, processing (including blending or repackaging) and releases of certain chemicals, if the facility employs 10 or more full-time employees and manufactures or processes more than 25,000 pounds of a TRI-listed chemical or otherwise uses more than 10,000 pounds of a listed chemical in a given year. Legislative Update: NACD signs letter in support of NPDES amendment to Senate Farm Bill

NACD has signed an industry coalition letter to the United States Senate asking for support and inclusion in the Farm Bill of an amendment to eliminate duplicative permitting requirements for pesticides. In late 2011, the U.S. Environmental Protection Agency began implementing a court order requiring pesticide applications in and around U.S. waters to be covered by National Pollutant Discharge Elimination System permits under the Clean Water Act. The Farm Bill amendment would have prevented duplicative regulation by exempting discharges involving the application of pesticides authorized for sale, distribution or use under the Federal Insecticide, Fungicide and Rodenticide Act as long as the pesticides were used for their intended purposes and in compliance with labeling requirements. Regulatory Update: OSHA issues revised head protection requirements

On June 22, the U.S. Occupational Safety and Health Administration published a direct final rule in the Federal Register announcing the revision of its personal protective equipment sections as they relate to head protection requirements. According to OSHA, the standards are being updated to recognize the 2009 edition of the American National Standard for Industrial Head Protection, and to delete references to the previous, out-of-date editions of that national consensus standard. State Regulatory Update: California adds chemicals to Prop 65 list

Effective June 22, the Office of Environmental Health Hazard Assessment of the California Environmental Protection Agency has added several new substances to the Proposition 65 list. Proposition 65 is the list of chemicals known to the State of California to cause cancer for purposes of the Safe Drinking Water and Toxic Enforcement Act of 1986. More

EPA announces action on SNURs including for rare earth substances

The Environmental Protection Agency is withdrawing significant new use rules issued under the Toxic Substances Control Act for eight substances that were the subject of premanufacture notices. The SNURs are being withdrawn following EPA's receipt of a notice of intent to submit adverse comments on these rules. More



PHMSA folds in rail special permits

PHMSA has published its final rule under HM-216B, incorporating a number of special permits relating to transport by rail into the Hazardous Materials Regulations. Many of the changes are technical in nature, but the rule, based on an NPRM published in August 2011, will allow the use of electronic shipping documents and provides for an alternative tank car qualification program.
