Regulatory Alert — EPA Conducting General Duty Clause Inspections
NACD has learned the U.S. Environmental Protection Agency (EPA) Region III is conducting Clean Air Act Section 112(r)(1) General Duty Clause inspections for Risk Management Program (RMP)-listed chemicals below the threshold quantity. Click here to view the inspection checklist, which contains a number of RMP Program 2 and 3 elements, plus some additional items.

Legislative Update — Senate Committee Approves Four-Year CFATS Extension
Last week, the Senate Committee on Homeland Security and Governmental Affairs approved draft legislation on the Chemical Facility Anti-Terrorism Standards (CFATS) program administered by the Department of Homeland Security. The proposed legislation would fund the CFATS program for multiple years, providing the industry with much-needed certainty, and is similar to a House bill passed earlier this month. NACD supports both pieces of legislation and urges the Senate to bring the bill to the floor for a full vote.

Regulatory Update — EPA Fines Company for General Duty Clause, Other Violations
Last week, the U.S. Environmental Protection Agency (EPA) reached a settlement with AllenCo Energy, Inc., requiring the company to pay $99,000 for violations of the Clean Air Act General Duty Clause, the Emergency Planning and Community Right-to-Know Act, and Spill Prevention, Control, and Countermeasures regulations. This penalty is in addition to the ongoing work identified in an April 2014 consent agreement with the EPA.

Regulatory Update — Less Than 90 Days Left to Comment on the EPA's Proposed Expansion to Its Risk Management Program
On July 31, the U.S. Environmental Protection Agency officially published its Request for Information (RFI) on potential revisions to its Risk Management Program regulations and related programs to modernize its regulations as required under Executive Order (EO) 13650: Improving Chemical Facility Safety and Security. Regulatory Resources — FMCSA to Hold Webinars on Changes to SMS Website
The U.S. Department of Transportation’s Federal Motor Carrier Safety Administration (FMCSA) has recently enhanced its Safety Measurement System (SMS) Website. The changes do not modify the SMS methodology or affect a carrier’s safety rating, which is subject to 49 CFR part 385, Safety Fitness Procedures. Instead, the FMCSA says, the changes improve upon the way SMS data is displayed, helping to further the agency’s nationwide commitment to safety by making important safety information easier to access and understand for motor carriers that want to improve their safety performance and compliance.

34-Hour Restart Takes Center Stage at Senate Safety Hearing

A Senate hearing on truck safety was dominated by the ongoing struggle over the 34-hour restart provision of the hours of service rule. Anne Ferro, in what was probably her last congressional testimony before she steps down as chief of the Federal Motor Carrier Safety Administration, defended the restart. The provision, which requires drivers to take two periods off between 1 a.m. and 5 a.m. during their 34-hour restart and limits use of the restart to once a week, puts common-sense limits on the most extreme driving schedules, Ferro said.

CNBC Airs Trucking Industry Investigation
Tire Business
Cable business station CNBC has begun airing a four-part investigative series, "Collision Course," about trucking accidents on the nation's highways. CNBC cites statistics from the Federal Motor Carrier Administration, which said nearly 4,000 people died in trucking accidents in 2012 — up 18 percent from 2009. The station said it is setting out to determine what is being done to ensure better safety on U.S. roads.

C&EN's Global Top 50 Chemical Firms for 2014

Germany won soccer's World Cup championship final earlier this month. The country also won — or at least Germany's BASF did —C&EN's Global Top 50 ranking of the world's largest chemical producers. But unlike in the soccer tournament, where Germany was a main contender but not the hands-down favorite, there was little doubt that BASF would come out on top of the C&EN survey.

Senate clears highways, transit patch, punting the issue until May

The nation's highway and mass transit programs can breathe easy for another 10 months after Senate Democrats relented and cleared a GOP-crafted $11 billion extension they had overwhelmingly rejected two days ago. But as happy as transportation interests will be to have something — anything — in place soon, the bill’s passage nevertheless represents a defeat for asphalt, trucking and other business groups that have long pushed for a hike in the gas tax and a five- or six-year transportation bill.
