Regulatory Resources — NACD Releases Updated Regulatory Checklist and Table Format
An updated version of the Regulatory Checklist and Resources for Chemical Distributors document is now available. The latest changes include the addition of the Alcohol and Tobacco Tax and Trade Bureau's regulation on Denatured Alcohol and several new and updated links to various resources. The Regulatory Checklist is a valuable tool for members that includes a list of the major federal regulations applicable to chemical distributors and links to find out more about these requirements. The lists are available here.

Regulatory Update — DHS Announces Listening Sessions on Potential CFATS Changes
The U.S. Department of Homeland Security (DHS) has announced a series of public listening sessions and webinars to collect input on its Chemical Facility Anti-Terrorism Standards (CFATS) Advance Notice of Proposed Rulemaking (ANPRM). DHS intends for each listening session to be a public forum for the discussion of potential revisions to CFATS regulations. Those in attendance will have the opportunity to provide input on aspects of the CFATS program including, but not limited to, the general regulatory approach, treatment of non-traditional chemical facilities, clarity of terminology, Risk-Based Performance Standards, and the Appendix A list of chemicals. Regulatory Update — PHMSA Issues Proposed Rule on DOT Special Permits and Approvals
Earlier this month, the U.S. Department of Transportation's (DOT) Pipeline and Hazardous Materials Safety Administration (PHMSA) published a proposed rule to revise the Hazardous Materials Regulations to reinforce the standard operating procedures and criteria used to evaluate applications for DOT special permits and approvals. The proposed amendments do not change the special permit and approval policies PHMSA established internally several years ago.

Regulatory Update — OSHA Publishes Proposed Rule on Improving Tracking of Workplace Injuries and Illnesses
Earlier this year, the Occupational Safety and Health Administration (OSHA) published a notice of proposed rulemaking to amend the agency's regulation on the annual OSHA injury and illness reporting requirements to add three new electronic reporting obligations. NACD filed comments expressing concerns about the proposal, which would make the information publicly available on the Internet.

Regulatory Update — DOT Announces $20.2 Million in Hazardous Materials Emergency Preparedness Grants
Earlier this month, Transportation Secretary Anthony Foxx announced grants totaling $20.2 million to states, territories and tribes for planning and training to improve the nation's response to transportation incidents involving hazardous materials, such as crude oil rail spills. The Hazardous Materials Emergency Preparedness program is designed to allow grantees the ability to implement planning and training programs that address each community's unique emergency planning needs.

Regulatory Alert — DHS Releases National Protection Framework
The U.S. Department of Homeland Security has released the 2014 National Protection Framework. The Framework describes what the "whole community" should do to safeguard against acts of terrorism, natural disasters, and other threats or hazards. The whole community comprises individuals (including those with disabilities and others with access and functional needs), businesses and nonprofits, faith-based and community groups, schools, and all levels of government. The Protection Framework also describes the core capabilities; roles and responsibilities; and coordinating structures that facilitate the protection of individuals, communities, and the nation.

FMCSA Names Acting Administrator

As Anne Ferro wraps up her time as administrator of the Federal Motor Carrier Safety Administration this week, the agency has named the agency's chief counsel, Scott Darling, to serve as acting administrator until a permanent administrator can be named. Deputy Administrator Bill Bronrott also will be leaving his role at FMCSA by the end of the year, but will continue in his role as in the meantime.

Carrier to Pay Drivers Fired for Participating in FMCSA Investigation

This amount is considerably less than the $1.07 million that OSHA originally ordered the carrier to pay, as Gaines appealed the ruling that was announced last November. OSHA spokesperson Michael D’Aquino said a mediator helped decide the new settlement, which does not include the punitive damages included in the original settlement.

Chemical Safety Board Blames Loose Pipe Fittings for Tesoro Refinery Spill

Keywords: The US Chemical Safety Board (CSB) released a technical evaluation report on tubing samples taken from the Tesoro refinery in Martinez, California, concluding that a sulfuric acid spill on February 12, 2014, resulted from insufficient tightening between a tube and a compression joint at a sulfuric acid sampling station.

U.S. Chemicals Output Up 1.2 Percent in July, Says ACC

Chemical production in the U.S. increased 1.2 percent in July, compared with the same month last year, according to the latest data from the American Chemistry Council (ACC). The ACC said that the U.S. chemical production regional index showed an increase of 0.4 percent last month after a downwardly revised 0.2 percent gain in June.
