Regulatory Update — DuPont to Pay $1.275 Million Penalty to EPA for Clean Air Act General Duty Clause, RMP, and EPCRA Violations
Last week, the U.S. Environmental Protection Agency (EPA) and Department of Justice announced a settlement with E.I. du Pont de Nemours and Company (DuPont) at its Belle, West Virginia, facility for eight alleged releases of harmful levels of hazardous substances between 2006 and 2010. DuPont will pay a $1.275 million penalty and will take corrective actions to prevent future releases to resolve the alleged violations of the general duty clause and risk management provisions of the Clean Air Act, the emergency response provisions of Section 103 of the Comprehensive Environmental Response, Compensation and Liability Act, and Section 304 of the Emergency Planning and Community Right-to-Know Act. Regulatory Update — EPA to Hold Industry Outreach Webinar Tomorrow on Hydraulic Fracturing Notice
The U.S. Environmental Protection Agency's (EPA) Office of Pollution Prevention and Toxics (OPPT) will hold an industry outreach webinar on its Hydraulic Fracturing Chemicals and Mixtures Advance Notice of Proposed Rulemaking (ANPRM) tomorrow, Sept. 3, at 4 p.m. Eastern Daylight Time. EPA published the ANPRM in the Federal Register on May 19 in response to a citizen petition submitted under section 21 of the Toxic Substances Control Act (TSCA). Click here to register.

Regulatory Update — FMCSA Announces Changes to Improve Inspection Violation Data in Systems
Last week, the U.S. Department of Transportation's Federal Motor Carrier Safety Administration (FMCSA) announced the implementation of changes to state and federal data systems that will allow states to reflect the results of adjudicated citations related to roadside inspection violation data collected in the Motor Carrier Management Information System (MCMIS). The policy on recording results of adjudicated citations in FMCSA data systems only applies to citations issued during roadside inspections occurring on or after Aug. 23, 2014.

Business Update — Tentative Agreement Reached on Health Benefits for West Coast Port Workers
Last week, the International Longshore and Warehouse Union (ILWU) and the Pacific Maritime Association (PMA) announced that they have reached a tentative agreement on terms for health benefits, subject to agreement on the other issues in the negotiations. The parties have agreed not to discuss the terms of this tentative agreement as negotiations continue.

Groups Ask DOT to Hide CSA Scores from Public View

Ron Wyden: Federal Legislation to Increase Oil Train Safety May Be Needed

U.S. Sen. Ron Wyden, an Oregon Democrat and outspoken advocate for improving oil train safety, has repeatedly criticized loopholes in the U.S. Department of Transportation's proposed safety rules. It may be working. After meeting last week in Eugene with first responders and a top federal transportation safety official, Wyden said he's "encouraged" he's being heard.

Cargo Rates Trigger Shipper Backlash as U.S. Rails Soar

Following a decade of increases that sent rail profits and stocks to records, shippers such as Diversified and Dow Chemical Co. are asking the U.S. government to help them fight back. They want to be able to compel railroads to hand off cargo to a rival in mid-journey and make it easier to challenge higher rates with the U.S. Surface Transportation Board. Those demands are setting up a showdown in Washington, where railroad lobbyists say that easing the 1980 law that ended price controls would threaten the industry's renaissance.

EPA Releases Three Final Chemical Risk Assessments

The EPA on Aug. 28 released three final risk assessments for specific uses of three chemicals found in common household products. These final assessments and the recently released TCE risk assessment, which identified concerns for certain uses, were developed as part of the agency's Toxic Substances Control Act (TSCA) Work Plan, which identified chemicals for review and assessment of potential risks to people's health and the environment.

EPA Pressed for Time Limits on Chemical Trade Secrets

A coalition of environmental, labor and public health groups is petitioning the Environmental Protection Agency to set time limits on information deemed "confidential" by the chemical industry. Right now, there is no expiration date on confidentiality claims submitted by processors or manufacturers of chemicals to the agency, which the groups argue "threatens" public health.

Big Food to Divulge Chemical Info

Food companies are trying to beat the federal government's push to make chemicals in food more transparent. The Grocery Manufacturers Association, which represents America's biggest food companies, has planned a major new initiative that will give the Food and Drug Administration access to a large database of safety information for chemicals commonly used in processed foods, from Twinkies to almond milk.
