    NACD Asks Labor Department to Withdraw Proposed Overtime Rule
    NACD has joined with more than 100 other members of the Partnership to Protect Workplace Opportunity (PPWO) in submitting comments to the U.S. Department of Labor (DOL) asking the agency to withdraw its proposed rule that would raise the salary threshold at which eligible workers qualify for overtime pay.

    Shipments of Hazardous Materials to China
    It appears that as a result of the explosions at the Tianjin Port, the Chinese government has intensified inspections of chemical shipments into the China. NACD has learned that recent shipments of hazardous cargo into certain ports in China have been subject to requirements for the identification of hazardous materials freight containers and that some shipments of these containers within certain ports have been prohibited.

    Significant New Use Rule on Substituted Cyclosiloxane; Removal
    EPA
    EPA is removing a significant new use rule (SNUR) promulgated under the Toxic Substances Control Act (TSCA) for substituted cyclosiloxane that was the subject of a premanufacture notice (PMN). EPA published this SNUR using direct final rulemaking procedures. EPA received a notice of intent to submit adverse comments on this rule. Therefore, the Agency is removing this SNUR. EPA intends to publish a proposed SNUR for this chemical substance under separate notice and comment procedures.

    Pennsylvania Company to Pay $186,000 to Settle RCRA and EPCRA Violations
    EPA
    Zippo Manufacturing Company will pay a $186,000 penalty to settle alleged violations of hazardous waste regulations at its manufacturing facility in Bradford, Pa., the U.S. Environmental Protection Agency announced recently.

    FMCSA Grants Hours-of-Service Exemption to Hazmat Drivers

    The Federal Motor Carrier Safety Administration has granted an hours-of-service exemption to truck drivers who transport hazardous materials. FMCSA’s decision follows a request from the Arlington, Virginia-based American Trucking Associations, which argued on behalf of hazardous materials truck drivers. ATA said drivers were required by the Pipeline and Hazardous Materials Safety Administration to stay with cargo while stopped, which directly interfered with the drivers’ ability to obey FMCSA’s off-duty rest break requirement.

    Top 10 Toughest States on Hours of Service Violations

    Oregon was the 2013 leader on this list, and its percentage of issued hour infractions fell by only a point in our analysis of the 2014 data. All states are ranked according to the percentage of all violations their total number of hours of service violations issued to drivers makes up. Though next week’s nationwide enforcement focus is ostensibly brakes, you can be certain those detailed Level 1 inspections on the brakes and other vehicle systems will include a log check. The states detailed in the map above have commercial vehicle enforcement programs that go well beyond the national average of 10 percent hours violations.

    Southern California Ports to Adopt Appointment System

    Several terminals operating at the Ports of Los Angeles and Long Beach have agreed on an initiative to establish appointment systems for trucks delivering containers to and from the ports. Ten PierPass-member container terminals have adopted an appointment system action plan committed to a set of common requirements.

    Another Chemical Plant Explosion in China

    An explosion at a chemical factory in eastern China has killed at least one person, according to government-run media, the latest in a series of deadly warehouse blasts that have raised questions about insufficient safety regulations. Pictures on Chinese social media showed a large fireball rising from what appeared to be an industrial area in Dongying, located in the eastern province of Shandong province late Sept. 1.

    Bill Aims to Upgrade Safety for Materials Sent by Rail

    A push for stiffer hazardous chemical rail transportation standards was made Sept. 2 near the site of a train accident that caused the largest evacuation in Ohio history. Local officials — recalling the 1986 Miamisburg train derailment — joined Sen. Sherrod Brown, D-Ohio, as he stressed the need to pass a bill that would require higher national safety standards for rail movement of hazardous materials.

    Could Tobacco Carveout Kill TPP?

    The Trans-Pacific Partnership’s rocky road in Congress faces a fresh threat from tobacco-state senators. A brief trip down memory lane: Trade Promotion Authority passed with 62 votes in June, paving the way for a simple-majority threshold for the 12-nation trade deal. But to get there, TPA required legislative jujitsu packaged with other bills, complex vote sequences and a ping-pong with the House to draw enough votes.
