Legislative update: Senate committee votes to extend CFATS

The Senate Appropriations Committee has voted to extend the Department of Homeland Security's authority to implement the Chemical Facility Anti-Terrorism Standards for an additional year until Sept. 30, 2012 under the Fiscal Year 2012 Homeland Security Appropriations bill. The House of Representatives approved this measure in June. More

Security update: DHS reminds industry to remain vigilant against theft and diversion of chemicals

The U.S. Department of Homeland Security has launched an effort to remind key industries, including the chemical industry, to remain vigilant against the theft and diversion of chemicals that could be used as terrorist weapons. DHS hosted a recent conference call for key industry leaders, including NACD, on this issue. On the call, DHS officials said that they had no specific credible threat information, but remain concerned that terrorists continue to seek materials that can be used to make explosives. More

The U.S. Court of Appeals for the Seventh Circuit has vacated an April 5, 2010 Federal Motor Carrier Safety Administration final rule requiring interstate commercial truck and bus companies with serious patterns of hours-of-service violations to install electronic onboard recorders in all of their vehicles. More

The U.S. Department of Transportation's Federal Motor Carrier Safety Administration has released the University of Michigan Transportation Research Institute independent evaluation of the Compliance, Safety, Accountability program's Operational Model Test. More

Regulatory update: Labor Department issues six-figure fines to railroads for whistleblower protection violations

The U.S. Department of Labor recently issued two six-figure fines against railroad companies for alleged violations of whistleblower protection rules. In one case, DOL ordered Union Pacific Railroad to pay more than $615,000 for terminating two employees and suspending one in retaliation for reporting workplace safety concerns and a work-related injury. In another case, DOL ordered Burlington Northern Santa Fe Railway to pay more than $300,000 for suspending an employee for 30 days without pay for notifying the company of a work-related injury. More

The Federal Bureau of Investigation will hold Weapons of Mass Destruction Chemical Industry Outreach Days on Thursday, Sept. 22 in Northern Virginia and on Wednesday, Sept. 28 in Dallas. The first half of each day will involve presentations on intelligence and threats, and the second half of each the day will be a trip to a bombing range for an explosives demonstration. More

EPA to issue list of chemicals that warrant review for possible regulation

The Environmental Protection Agency by late fall will release a list of chemicals it has determined warrant further scrutiny due to available hazard and exposure information, a conclusion that could lead to the eventual regulation of some compounds. Wendy Cleland-Hamnett, director of EPA's Office of Pollution Prevention and Toxics, told an agency-sponsored webinar that after EPA publishes the list, companies and other interested parties will be able to submit additional information they have to improve the agency's assessment of a chemical's risks. More
