Regulatory Update — NACD Asks EPA for Extension on RMP Comment Deadline
Last week, NACD Vice President of Regulatory Affairs Jennifer Gibson sent a letter to the U.S. Environmental Protection Agency requesting a 90-day extension of the comment deadline for the Agency's Request for Information on Potential Revisions to the Clean Air Act Risk Management Program Regulations (RMP). EPA provided for a 90-day comment period with submissions due Oct. 29. A 90-day extension would move the deadline to Jan. 27, 2015.

Regulatory Update — FRA Proposes New Rules for Brake Systems on HazMat Trains
Earlier this month, the U.S. Department of Transportation's Federal Railroad Administration (FRA) published a proposed rule requiring trains carrying certain hazardous materials to apply stringent brake system standards for unattended rail equipment. This proposed rule codifies many parts of the emergency order issued in 2013 after the tragic accident in Quebec. The FRA estimated that this rule would cost almost $100,000 over 20 years. Regulatory Update — New FDA Reinspection Fee Rates Effective Tomorrow
The Food Safety Modernization Act provided the Food and Drug Administration (FDA) with the authority to assess and collect fees from, in part: (1) The responsible party for each domestic facility and the U.S. agent for each foreign facility subject to a reinspection, to cover reinspection-related costs; (2) the responsible party for a domestic facility and an importer who does not comply with a recall order, to cover food recall activities associated with such order; and (3) each importer subject to a reinspection to cover reinspection-related costs. These fees are effective Oct. 1, and will remain in effect through Sept. 30, 2015.

California Proposes Major Changes to Refinery PSM Standard

The California Department of Industrial Relations (DIR) has proposed a new Process Safety Management standard for oil refineries. The proposal, which is a precursor to formal notice and comment rulemaking, proposes a sweeping rewrite of the PSM standard for oil refineries as well as several new management system elements.

U.S.-NAFTA Freight Movements Gain 8.5 Percent in July, Led by Trucking
Truckinginfo
The amount of freight flowing between the U.S. Transportation Department figures show it totaled $101.1 billion, with increases in all five major transportation modes: air, vessel, pipeline, rail, and trucks. Of the $7.9 billion increase in the value of US-NAFTA freight from July 2013, truck freight contributed the most, $4.7 billion, followed by rail, $1.4 billion.
