OSHA Injury Reporting Final Rule Effective Jan. 1, 2015
The Occupational Safety and Health Administration (OSHA) is issuing a final rule to its Injury and Illness Recording and Reporting regulation. The final rule revises the requirements for reporting work-related fatality, injury, and illness information to OSHA.

EPA Drafts 'Community Right-to-Know' Document

The Environmental Protection Agency (EPA) is planning to submit an information collection request (ICR), "Community Right-to-Know Reporting Requirements under Sections 311 and 312 of the Emergency Planning and Community Right-to-Know Act." Before doing so, EPA is soliciting public comments on specific aspects of the proposed information collection.

EPA Updates List of TSCA 'Work Plan' Chemicals for Risk Analysis

The EPA has updated its Toxic Substances Control Act (TSCA) Work Plan for Chemical Assessments, the agency's list of priority chemicals for analysis, adding 23 new chemicals to the list while removing or consolidating 16 others.

EPA NPDES Electronic Reporting Proposed Rule

On July 30, 2013, the Environmental Protection Agency proposed the NPDES Electronic Reporting Rule that would require electronic reporting instead of current paper-based NPDES reports. This action would modernize NPDES reporting, save time and resources for regulated entities and regulatory agencies, better protect the nation's waters by improving compliance and provide the public with access to information that affects their communities.

EPA SNUR — Certain Nonylphenols and Nonylphenol Ethoxylates

EPA issued a proposed rule in theFederal Registerof Oct. 1, 2014, concerning 15 related chemical substances commonly known as nonylphenols and nonylphenol ethoxylates. For 13 NPs and NPEs, EPA proposed to designate any use as a "significant new use," and for two additional NPs, EPA proposed that any use other than use as an intermediate or use as an epoxy cure catalyst would constitute a "significant new use."

FMCSA Shuts Down Driver After Fatal Crash, Violation of Regulations

The Federal Motor Carrier Safety Administration announced Dec. 3 it has issued an imminent hazard shut down order for Florida-based long-haul driver James H. Patterson. The agency has ordered him not to operate a commercial vehicle in interstate commerce.

FMCSA Advance Notice — Financial Responsibility for Motor Carriers, Freight Forwarders, and Brokers

FMCSA announces that it is considering a rulemaking that would increase the minimum levels of financial responsibility for motor carriers, including liability coverage for bodily injury or property damage; establish financial responsibility requirements for passenger carrier brokers; implement financial responsibility requirements for brokers and freight forwarders, and revise existing rules concerning self-insurance and trip insurance. FMCSA seeks public comments on these topics.

Battle Over Truck Driver Hours of Service Law Reaching Peak
Congress is considering a major change to federal regulations that will dramatically increase the number of hours a semi-truck driver is allowed to work in a week from 70 to 82 hours. Only six months ago comedian Tracy Morgan was seriously injured and James McNair was killed in a horrific crash caused by a fatigued truck driver. U.S. Department of Transportation Secretary Anthony Foxx sent a letter urging Congress to reject this change.

GOP Senate Majority Grows as Cassidy Crushes Landrieu
The Hill
Rep. Bill Cassidy (R-La.) easily ousted incumbent Sen. Mary Landrieu (D-La.) in their recent Senate runoff, capping off a dominating midterm election for Republicans. The GOP's victory in the final race of the 2014 cycle cements their nine-seat pickup in the upper chamber, giving them a 54 to 46 advantage over Democrats come January. Though Senate control wasn't in the balance, Cassidy's win is nonetheless an exclamation point on a midterm cycle that saw big gains for Republicans.

This Week: Lawmakers Aim to Pass Big Bills, Leave Town
The Hill
It's crunch time as Congress has only a few days to avoid a government shutdown. Leaders in both parties hope to adjourn for the year by Thursday, which is the same day the current government funding bill expires. The House Appropriations Committee plans to release the "cromnibus" spending bill on Monday, which would fund all of the government through September 2015 except for the Department of Homeland Security. Agencies dealing with immigration policy would only be funded through late winter, likely into February.
