President Obama Signs NPMA Spearheaded Legislation into Law

President Barack Obama signed legislation into law Friday, Feb. 7, that retains the food uses for the fumigant sulfuryl fluoride. The measure is part of the much larger, 950-page plus Farm Bill Conference Report. The enactment of the sulfuryl fluoride provision represents a monumental legislative victory for NPMA — one that would not have been possible without NPMA members lobbying their federal lawmakers about the importance of retaining sulfuryl fluoride's food uses.

The legislation effectively reverses a proposed order revoking or withdrawing sulfuryl fluoride's food tolerances that U.S. EPA put forward in January of 2011 under the threat of activist group litigation. The activists claimed that sulfuryl fluoride's tolerances were not permissible because the "risk cup" for sulfuryl fluoride was already filled with fluoride in drinking water and dental care products.

New Jersey Department Fines Neptune City Company $495,000 for Misapplying Pesticides, Revokes Firms Applicator License

The New Jersey Department of Environmental Protection (NJ DEP) recently fined a Neptune City pest control business $495,000 for misapplying pesticides at numerous locations including multifamily housing and various restaurants. The NJ DEP has also revoked the firm's pesticide applicator business license and the business owner's commercial pesticide applicator license. Violations include repeatedly misusing fipronil by applying the product in indoors areas that the label specifically prohibits. Click here to see NJ DEP's enforcement order.

NPMA reminds you that the use of fipronil indoors is prohibited, except for label-specified applications for termite control, foam applications to wall voids for control of listed pests and labeled bait applications. The misuse of this product could be extremely costly for you and your company and could lead to restrictions on its use or even imperil its continued availability. Always read and follow all label instructions.

EPA Announces Final Plan for Federal Certification of Pesticide Applicators within Indian Country

The U.S. Environmental Protection Agency recently finalized the EPA Plan for the Federal Certification of Applicators of Restricted Use Pesticides (RUPs) within Indian Country. The EPA is taking this step to make RUPs available for use in Indian country where no current certification mechanisms exist. This action will give pesticide applicators who apply or seek to apply pesticides in Indian country access to the same pest control tools available elsewhere in the United States and ensure that these applicators have met competency standards. Generally, state pesticide applicator certifications are not valid in Indian country, and most areas of Indian country do not have other certification mechanisms. Maryland General Assembly Set to Consider Bed Bug Bill

A Maryland lawmaker recently introduced legislation in the Maryland Senate requiring lodging establishments to consult and contract with a licensed pest management professional to remediate bed bugs when there is evidence of an infestation. Click here to read Senate Bill 792.

Iowa Considers Legislation to Permit Online Recertification

The Iowa Legislature is considering a bill that would allow certified pesticide applicators to renew their certification by completing the required hours of instructional courses via the internet. The Iowa Department of Agriculture and Land Stewardship (DALS) is not required to implement the bill unless the Legislature appropriates the necessary moneys to implement the legislation. The measure would be repealed if DALS is not appropriated the necessary amount by July 1, 2019. Click here to read House File 2112.

Termite Reporting Bill Dropped in Arizona

A bill was recently introduced in the Arizona Legislature making the state's longstanding termite reporting system voluntary. Since the late 1980s, AZ PMPs have been required to submit to their regulatory agency a termite action reporting form or a TARF after most termite treatments. The regulatory agency, presently the Department of Agriculture, subsequently posts the information on its website, making it possible for realtors, prospective home buyers and others to see the termite treatment history for a property. Neonicotinoid Bill Introduced in Maryland

The Maryland General Assembly will soon consider legislation classifying all neonicotinoid pesticides as restricted use pesticides. Thus, only a certified applicator would be able to purchase and apply such pesticides. Several other states including Alaska, Maine, Oregon, New Jersey, New York and Vermont, as well as Puerto Rico, are also considering measures to restrict or ban the use of neonicotinoid pesticides. 2013 Viking Office of the Year Winner

Viking Termite & Pest Control's Manager Erin Schempp and the team from the Cape May branch were recently awarded the "Viking Battle Helmet of Triumph" to put on display in 2014, and every team member received a cash prize for this accomplishment at the dinner celebration in Atlantic City, N.J.

"It was a great pleasure to celebrate the 2013 Viking Office of the Year winner, Cape May, N.J.," said Ryan Bradbury, president of Viking Termite & Pest Control. Orkin Acquires Pugliese Pest Solutions

Orkin recently expanded its employee and customer base in New York by acquiring Pugliese Pest Solutions on Feb. 3. Orkin acquired the family-owned company from Rick and Fran Pugliese whose father, F.J. Pugliese, founded Pugliese Pest Solutions in 1963. The company started out servicing the dairy industry in Utica and the Mohawk Valley and eventually expanded to the rest of the state.

In Memoriam: Mitchell Rene Bourgeois
NPMA
Mitchell Rene Bourgeois of Baton Rouge, La. passed away in his sleep at the age of 59 on Tuesday, Feb. 4, 2014. Mitch worked in the pest control business with his father after receiving an honorable discharge from the Navy and eventually acquired and operated Mr. B's pest control services.
