Recidivism risk assessment as sentencing tool is controversial

Before the gavel falls in a judge's sentencing decision, the judge has balanced the current charges against the defendant's criminal history. But soon, Pennsylvania judges at sentencing may also consider whether the lawbreaker is predicted to re-offend. Prompted by spiraling out-of-control correction costs, the state Legislature in 2010 tasked the Pennsylvania Sentencing Commission with creating a risk assessment tool to better manage strained state resources and slow the revolving prison door.
