'Unreviewable': HHS asks DC Circuit to curb hospitals' 340B suit

The federal government argued in a court filing this week that an appellate judge should dismiss a lawsuit brought by a long list of hospital organizations challenging a reduction in payments under the 340B Drug Pricing Program. The plaintiffs argue that the program is needed to improve patient care. But the government argues the judiciary has no authority to review the Outpatient Prospective Payment System (OPPS) rates set each year by Health and Human Services (HHS).
