PHTA Sends Letter to Chairs of MA Joint Committee on Public Health
PHTA submitted testimony on the importance of pool maintenance to public health and safety to the legislature's joint public health committee, in advance of the May 18 release of a task force report.
Additionally, last week, the Commonwealth of Massachusetts released essential services-related information on its essential services FAQ website.

Federal Update
As states remain on the front lines of the COVID response and assess resuming economic activities, Congress and the Administration are confronted with the fact that many of the previous COVID response measures are almost depleted or are coming to an end and have only had a partial impact on stemming the country's financial crisis. Today's unemployment numbers illustrate the crisis in stark terms: one-in-four Americans have lost their job. At the same time, COVID-19 cases continue to increase in many areas, and concerns about a resurgence or second wave rise with communities resuming economic activity.
In response, House Speaker Pelosi is preparing a "CARES 2" package for floor action as early as next week. It is expected to be at least another $2T. Here is what's on the "most likely" list for CARES 2:
- More funds - and possible program modifications - for the Paycheck Protection Program
- More aid for state and local governments
- Additional aid for COVID-19 health care response, testing and contact tracing

Reopening Guidance Released
PHTA issued guidance for members and for Health Departments on the topic of reopening public pools. This past Saturday, the CDC issued reopening guidance. Regulatory Measures Impacting Swimming Pool and Spa Rules Are Moving in Wyoming
The Wyoming Department of Agriculture has proposed rules to update the public swimming pool and spa code in the state. Wyoming currently recognizes the International Swimming Pool and Spa Code at a local level. The amendments to the statewide public pool and spa rule incorporate by reference the 2018 International Swimming Pool and Spa Code and the NSF/ANSI 14-2018, Plastic Piping System Components and Related Materials and Equipment for Swimming Pools, Spas, Hot Tubs, and other Recreational Water Facilities. The amendments also:
1) make necessary clarifications and updates to pool and spa licensing and safety rules,
2) add safety standards for interactive play aquatic features,
3) include turnover rates for lazy rivers, interactive play features, and wave pools,
4) revise the lifeguard standards for general-use pools to accommodate sanctioned competitions at general-use pool,
5) add requirements regarding service animals and when license holders may allow animals in pools, and
6) add safety requirements to address contamination from fecal matter, vomitus, or blood among other changes.
PHTA will be working with the International Code Council (ICC) to provide comments on the matter. Public comments will be accepted until June 24, 2020. If you wish to get involved with the revision process, please contact Brendan Scanland at bscanland@phta.org

Oregon Department of Energy Announces Upcoming Rulemaking for Energy Efficiency Standards
The Oregon Department of Energy will be conducting rulemaking to update Oregon Administrative Rule Chapter 330 Division 92 regarding Energy Efficiency Standards (or Appliance Standards). This rulemaking is in response to Executive Order 20-04, which was signed by Governor Kate Brown in March 2020 and directs ODOE to establish standards for products including the following:
1. High CRI fluorescent lamps
2. Computers and computer monitors
3. Faucets
4. Shower heads
5. Commercial fryers
6. Commercial dishwashers
7. Commercial steam cookers
8. Residential ventilating fans
9. Electric storage water heaters (demand response design requirement)
10. Portable electric spas
ODOE will launch a rulemaking process to establish new rules for energy efficient products by Sept. 1, 2020, as directed in EO 20-04. This rulemaking will focus on aligning Oregon with energy efficiency standards of our west coast neighbors.
ODOE is interested in holding a stakeholder advisory meeting to help inform rulemaking as the agency engages in this process. This meeting will have capability for remote participation. ODOE will be seeking feedback on such aspects as the proposed efficiency standards, effective dates, product registration, and labeling requirements. ODOE is also interested in hearing from stakeholders on whether there are additional product standards that could be established with this rulemaking.
While the primary focus of this rulemaking is on the standards directly listed in EO 20-04, ODOE would also like to hear from stakeholders on additional opportunities. This effort represents a continuation of ODOE's ongoing work on appliance standards, including publication of a report in 2018 as part of Executive Order 17-20 which identified appliance standards opportunities for Oregon.
This rulemaking will be accompanied by development of an agency Legislative Concept for introduction during the 2021 Legislative Session, per the process outlined in ORS 469.261. A public meeting is expected to be held sometime this month. PHTA will be actively involved with this rulemaking process as we continue to advocate for APSP-14 inclusion in state energy efficiency appliance laws.
