Public Pools/Spas are Reopening! Click here to see whether commercial pools are opening up in your state. Some states are allowing commercial aquatic facilities to open but are requiring strict guidelines. This reopening chart will be posted on our website and updated each week. Be sure to keep checking if your state has not yet decided to reopen pools.
Updated PHTA Pool/Spa Reopening Guidance: The CDC submitted guidance on reopening commercial pools and spas on May 9. PHTA has slightly updated its reopening guidance to align with the CDC. The newest version can be viewed here.

House Passes $3T HEROES Act
While states begin to determine economic reopening timelines and strategies the House passed the largest ever federal relief package, the $3T HEROES Act. This package includes historic levels of aid to state and local governments, more direct aid to individuals, families and front-line workers, more resources for hospitals and for COVID-19 test and tracing, more aid to businesses and employees, more aid for K-12 and higher education, and more aid for housing and transportation systems.

Senate Outlook
The Chair of the Federal Reserve Powell publicly encouraged more direct aid and a variety of bipartisan coalitions have begun to emerge in the Senate around key provisions, including state and local aid, testing and contact tracing, and additional direct aid to employers and employees, as well as for specific regions and sectors such as securing the food chain supply, as well as making significant changes to existing programs such as the Paycheck Protection Program to increase its effectiveness for businesses and their employees.
Key Senate priorities include:
- Liability protection/litigation shield for businesses that reopen while the pandemic is ongoing
- Reform of the unemployment benefits that are making it difficult for employers to entice workers to come back on the payroll

PHTA has provided legislative recaps for FL, CT, ME, MD, OR, NM, SD, and UT. Other states that have adjourned for the session include: AZ, MD, VA, WV, AR, MN, WY, ID, WA. PHTA will be providing recaps on these states, and others as they continue to adjourn, in the coming weeks.
Maryland: MD Department of Health final rules effective 11/2/2020: Public Swimming Pools and Spas
The Department adopted amendments to public swimming pool and spa rules. The rulemaking: (1) Simplifies the permitting requirements for construction, alteration, repair, and replacement of parts for pools and spas; (2) Reduces the frequency of inspections for pools and spas with a demonstrated history of compliance; (3) Clarifies and adds specificity to the conditions which may warrant the suspension of an operating permit; (4) Adds a mechanism by which the Department can ensure regulations are implemented and enforced consistently across the State; and (5) Makes general corrections and revisions to clarify the regulatory requirements of pools and spas.
Notice of the final rule was published in the 5/8/2020 edition of the Maryland Register of Regulations. The rules will take effect on 11/2/2020 and can be viewed here.
Massachusetts:
PHTA continues to monitor the phased reopening in Massachusetts, specifically with retail. Retail will be allowed via curbside fulfillment until Phase 2. Before businesses reopen, the Commonwealth is asking those prepared to reopen to sign a compliance checklist. New York:
NY Division of Code Enforcement guidance: Above-Ground Swimming Pool Barrier Requirements
The Division issued guidance to clarify some of the barrier requirements applicable to new or substantially modified residential above ground swimming pools. New or substantially modified swimming pools are required to be provided with temporary barriers during installation and with permanent barriers thereafter. As an alternate to a conventional on ground barrier, the barrier for above-ground or on-ground swimming pools, including quick set, inflatable swimming pools, is permitted to be mounted on top of the pool structure or the pool structure may constitute a barrier, when certain requirements are met. The guidance was issued on May 5, 2020.
