PHTA continues to monitor the phased reopening in many states. Not only are industry sectors like retail, construction, and manufacturing getting back to work, but aquatic venues are reopening in many states. We have provided a list of states that are reopening commercial and semi-commercial pool, spas, and other aquatic venues.

Payroll Protection Program and Additional Loan Forgiveness Guidance
The House and Senate have different versions of legislation to make changes to the Paycheck Protection Program (PPP). The differences will have to be reconciled and the legislation will have to pass both the House and Senate and be signed into law by the President, before any PPP changes go into effect. As the House and Senate work on their proposals, the most likely changes that will be made to the PPP in the near term (next week or two) are as follows:
- Extension of the deadline to apply for a PPP loan from June 30, 2020, to Dec. 31, 2020.
- Allow borrowers up to 16 weeks to use their funds, instead of the current 8 weeks.

Economic Aid Proposals Under Consideration at the White House
The Trump Administration proposals to aid the economy are beginning to emerge, with White House Economic Advisor Larry Kudlow discussing a payroll tax holiday, a capital gains exclusion for several years, a tax deduction for business spending at restaurants, significant incentives for companies to move back to the United States (commonly referred to as "onshoring") to include full expensing for return moves, a cut in the corporate tax rate, and a targeted tax credit.

President Trump Signs Executive Order on Regulatory Relief to Support Economic Recovery
On May 19, 2020, President Trump issued an Executive Order (EO) on Regulatory Relief to Aid Economic Recovery. This EO builds upon pre-COVID efforts by the Trump Administration to reduce the federal regulatory burden on companies large and small. The previous effort is often referred to as the "2 for 1" plan, where for every new regulation issued, Federal Departments and Agencies are required to propose the repeal of two other existing regulations. The President has broad authorities to suspend or alter federal regulations (as well as accelerate them) in emergency situations which are clearly applicable during COVID-19. The Administration has already temporarily suspended many regulatory requirements to aid the public health response to COVID-19 as well as to stem economic harm from COVID-19.
This new EO directs Departments and Agencies to further determine which of these changes should be made permanent, by directing them to "address this economic emergency by rescinding, modifying, waiving, or providing exemptions from regulations and other requirements that may inhibit economic recovery."Acknowledging that the power to do so is not absolute, the EO repeatedly includes the reference as "consistent with applicable law". Any permanent repeal of regulations (and even those that have already been made on a temporary basis) will inevitably face significant legal and Congressional challenges, particularly post the emergency period directly related to COVID-19.

Key Legislation, Regulations, and Local Matters Impacting the Industry
As of this week, the following states have adjourned Sine Die: AK, WA, OR, ID, WY, UT, AZ, NM, SD, MN, AR, AL, FL, VA, WV, IN, MD, CT, and ME. This week, PHTA has provided legislative recaps for WV and WY.
OHIO SB 309: This measure amends existing Ohio code to allow certified swimming classes to take place at a private residential swimming pool without requiring the pool's operator to obtain a public swimming pool license. The measure defines "private residential swimming pool" as an indoor or outdoor structure, chamber, or tank containing a body of water for swimming, diving, or bathing located at a dwelling housing no more than three families and used exclusively by the any of the following:
(1) The dwelling's residents;
(2) The resident's nonpaying guests;
(3) A paying guest of a resident if such guest is participating in a certified swimming class conducted by a certified swimming instructor and the instructor is conducting the certified swimming class on a one-on-one basis.
Defines "certified swimming class" as an infant swimming resource (ISR) class; an American red cross swimming class, swimming lesson, or learn-to-swim class; and any other swimming class authorized by the director of health.
Defines "certified swimming instructor" as a certified ISR instructor; a certified American red cross swimming instructor or swim coach; and any other swim instructor authorized by the director of health.
This measure is scheduled for last minute hearing on May 27 in the Senate Local Government, Public Safety and Veterans Affairs Committee. The hearing will be open to the public and testimony will be accepted at the discretion of the Chair, Senator Nathan Manning (R).
A vote may occur at the discretion of the Chair. In Ohio, measures typically receive at least three committee hearings prior to receiving a committee vote.

Regulations
UTAH: The Utah Department of Human Services issued a final rule, effective May 11, 2020: Foster Care Services. The Department adopted amendments to a rule concerning foster care services, including safety requirements to address drowning hazards in swimming pools, hot tubs, water features, ponds, or streams. The Department published notice of a final rule in the Utah State Bulletin. The rule is effective May 11, 2020.
MONTANA: The Department of Public Health and Human Services issued a final rule effective May 16, 2020. The Department adopted amendments to rules governing pools, spas, and other water features and referenced the 2018 International Swimming Pool and Spa Code (ISPSC).

What's Happening Locally?
Miami Beach, Florida: On May 22, 2020, City Council discussed a resolution urging Miami Dade County Mayor Gimenez to promptly authorize the City of Miami Beach to Re-Open pools in Multi-Family Residential Buildings within its geographic boundaries.
Montgomery County, Maryland: This week, Montgomery County health officials announced that public and private community pools will not open Memorial Day weekend for the traditional start of summer, due to COVID-19 restrictions affecting the health and safety of patrons and employees. Restrictions apply to pools operated by Montgomery County Recreation, as well as apartment and condominium complex pools, and private swim clubs.
Bethlehem, Pennsylvania: On May 19, 2020 Mayor Donchez announced that the City’s five municipal pools will not open this summer in order to prevent the spread of COVID-19 during the public health emergency.
Clark County, Georgia: On May 18, 2020, the Board of Health will consider an item pertaining to the transmissibility of COVID-19 at & around swimming pools.
Leawood, Kansas: On May 18, 2020 the City Council heard comments and came to a decision to open Municipal Pools.

Watch your mailboxes for details on the next GENESIS®is eager to announce their five pre-conference Design and Construction schools' events scheduled for the 2020 International Pool | Spa | Patio Expo, hosted at the Mandalay Bay Convention Center, Nov. 8-13, 2020 in Las Vegas, Nevada.
Leading the event will be the new C260: GENESIS CONSTRUCTION SCHOOL: Fiberglass Pools and C201: GENESIS CONSTRUCTION SCHOOL: Concrete Pools. Both schools will offer 24 hours of education taught by industry-leading subject matter experts.
Pre-Conference Design and Construction Schools
For individuals immersed within the GENESIS® program, three Society of Watershape Designer schools will begin on Monday, November 9 through Tuesday, November 10. D211: Elements of Design will be taught by SWD Registered, Jason Brownlee, ASLA; D231: Color Theory and Its Application will be presented by the dynamic Feras Irikat and our NEW! D280: History of Pools and Water Features is led by GENESIS Design Faculty Chair, Kate Wiseman, MLA.
