The choice of sanitizer can significantly impact the costs of operating a large aquatics facility. This article addresses potential costs associated with two commonly used sanitizers: Calcium hypochlorite (or cal hypo) and trichloroisocyanuric acid (or trichlor).

Rocky River police arrested a Michigan-based contractor on pollution charges that accused him of illegally dumping waste from a swimming pool over a cliff into the river.
Oscar Serratos-Lozano, who according to police works for Sam Pool Finishes, was arrested recently after a paddle boarder spotted blue material running down the cliffs where the river meets Lake Erie.

Assembly Bill 5, which passed the Legislature on September 9, was sent to the Governor yesterday (Sept 17). Governor Newsom has twelve days to sign, approve without signing, or veto the bill – all indications are he will sign the bill. AB 5 confirms and expands upon the recent decision by the California Supreme Court in Dynamex Operations West, Inc. v. Superior Court. This decision and AB5 will apply the "ABC" test to the question of employee vs. independent contractor. Workers will be classified as employees, unless the Company can demonstrate three elements.
AB5 does create several limited exceptions that may impact industry professionals, including excluding subcontractors if ALL 7 criteria can be met. A narrow exception is also included in the bill for a company that is acting solely as a referral agency but once again if a list of ALL 10 criteria are met.
This will continue to have a substantial impact for pool and spa installers/dealers and the service industry. In a vast majority of cases, the workers who build, renovate or service pools will be considered employees, not only about State wage and hour orders, but also about worker's compensation and unemployment insurance. AB5 also states that it should be applied retroactively where permitted.
PHTA encourages you to read the alert sent out describing how the exceptions work in detail and we urge companies to use caution and consider consulting legal counsel before asserting an exception from the "ABC" test.

Great News! PHTA's WAVE Young Professionals Steering Committee will sponsor the 2019 Million Dollar Pool Challenge student finalist. The Million Dollar Pool Challenge challenges designers to submit a pool design based on a proposed scenario. Five finalists, including one student will be selected to receive a trip to the International Pool | Spa | Patio Expo where they will present their design to their peers. Voting will be live, and the winner will receive a $5,000 cash prize. All finalist presentations will be presented on November 5 at 9:15 -10:30 a.m. during the Million Dollar Pool Design Challenge PSP Conference Program Session. Special thanks to PHTA WAVE Young Professionals Network Steering Committee Member Reid Schindler, Schindler Design Co., for all his hard work in creating and continually supporting this program.
