PHTA is pleased to announce its 2021 Board of Directors:
Franceen Gonzales (WhiteWater West, Richmond, British Columbia, Canada) has been appointed to serve as Chairman of the Board.

Understand ADA and ABA accessibility standards for pools and spas.
The United States Access Board is offering a free webinar on December 3 from 2:30 – 4:00 (ET) that ill review scoping and technical provisions for recreation facilities in the ADA and ABA Accessibility Standards. This session will address the requirements for amusement rides, recreational boating facilities, exercise machines and equipment, fishing piers and platforms, golf facilities, miniature golf facilities, play areas, swimming pools, wading pools, and spas, shooting facilities with fixed firing positions, and sports facilities. Presenters will address common sources of confusion and frequently asked questions about these provisions.

.ADVOCACY
COVID-19 Updates
Washington, D.C.: This measure requires employers to adopt certain policies for employees who are working during the Coronavirus pandemic. Status: Sent to Congress.
New York: Governor Andrew Cuomo has issued an executive order in response to the COVID-19 outbreak.
Georgia: This order extends Governor Brian Kemp's (R) previous executive order for empowering a healthy Georgia in response to COVID-19. The order still does not require a statewide mask mandate but still does allow municipalities to impose a Local Option Face Covering Requirement with certain exceptions.
Massachusetts: This order requires the early closure of certain businesses and activities each night at 9:30 PM.
Wyoming: This measure creates a temporary section of state code in order to waive examination and continuing education requirements due to the COVID-19 pandemic for applicable professions. Status: Prefiled, hearing held on 11/11/20.

Legislative Updates
Massachusetts: This measure provides that any entity that markets a service or product to the general public and substantially relies on individuals with which it contracts directly or indirectly as independent contractors to perform the service or provide or deliver the product is the employer of those individuals unless another entity pays worker compensation contributions on behalf of the individual. Such individuals may not be liable for worker compensation contributions. Status: Substituted for HB 4900; Passed House. Referred to Senate Committee on Ways and Means.
Massachusetts: This measure prohibits the sale of covered products that contain specified flame-retardant chemicals. Status: Introduced and referred to Senate Committee.
Wyoming: This measure provides for universal professional licensing reciprocity. Status: Prefiled; referred to Joint Corporations, Elections & Political Subdivisions Interim Committee. Hearing held on 11/9/20.

Local Updates
Annapolis, MD: On November 9, the Annapolis City Council will meet to discuss 1 ordinance and 2 resolutions related to making building code updates, including adoption of the 2018 ISPSC.
Oneida, NY: On November 2, the Common Council voted to adopt an ordinance amending Chapter 190, Article I of the Municipal Code concerning regulations for swimming pools to amend the definition of swimming pool. The definition includes permanent or aboveground pools and any portable pool, which can hold more than 24 inches of water.
Cape May, NJ: On October 10, the Borough Board of Commissioners heard the introduction of two ordinances amending portions of the Code to prohibit swimming pools in all zones, as well as adopt new requirements for maintenance of existing non-conforming pools and spas. A final vote is scheduled for the November 12, 2020 meeting.
