What You Need to Know about Monopersulfate

From June 12: PHTA is continually looking out for ways to protect our members and the industry. Before the summer begins, make sure that you know how to handle and use monopersulfate products correctly. Improper storage and handling could be dangerous for you, your clients and the pool or hot tub it is used on. DiGiovanni honored by ISHOF

From March 27: Association of Pool & Spa Professionals veteran Carvin DiGiovanni has been honored by the International Swimming Hall of Fame (ISHOF).
The APSP vice president of technical and standards is the recipient of the 2019 Paragon Award, presented to individuals or organizations who have made outstanding contributions to aquatics. He is being awarded in the recreational swimming category.

What You Need to Know About Assembly Bill 5

From Sept. 18: Assembly Bill 5, which passed the Legislature on September 9, was sent to the Governor yesterday (Sept 17). Governor Newsom has twelve days to sign, approve without signing, or veto the bill – all indications are he will sign the bill. AB 5 confirms and expands upon the recent decision by the California Supreme Court in Dynamex Operations West, Inc. v. Superior Court. This decision and AB5 will apply the "ABC" test to the question of employee vs. independent contractor. Workers will be classified as employees, unless the Company can demonstrate three elements.
AB5 does create several limited exceptions that may impact industry professionals, including excluding subcontractors if ALL 7 criteria can be met. A narrow exception is also included in the bill for a company that is acting solely as a referral agency but once again if a list of ALL 10 criteria are met.
This will continue to have a substantial impact for pool and spa installers/dealers and the service industry. In a vast majority of cases, the workers who build, renovate or service pools will be considered employees, not only about State wage and hour orders, but also about worker's compensation and unemployment insurance. AB5 also states that it should be applied retroactively where permitted.
PHTA encourages you to read the alert sent out describing how the exceptions work in detail and we urge companies to use caution and consider consulting legal counsel before asserting an exception from the "ABC" test.

The International Swimming Pool & Spa Code Gains Momentum

From June 12: The Pool & Hot Tub Alliance (PHTA) is proud to announce that our safety partner the National Drowning Prevention Alliance (NDPA) supports the adoption of International Swimming Pool & Spa Code (ISPSC) to help save lives When adopted, the ISPSC will provide the country's 13 -14 million backyard residential pools and spas the same level of high bather safety protection that the VGB mandates for the nation’s 300,000 public pools.

The Pool & Hot Tub Alliance Mourns the Passing of Gene Wells

From July 31: The Pool & Hot Tub Alliance (PHTA) is saddened by the passing of 2016 PHTA Fellow Gene Wells. Wells was a longtime industry member, who served as a member on PHTA's Board of Directors and numerous PHTA Standards Writing and Technical Committees. He passed away on July 17, 2019 at the age of 79-years-old.
Wells had been part of the pool and hot tub industry since 1969. He was one of the initial pioneers that paved the way for the PHTA standards program. Starting as early as the mid-1980s, he had the foresight, vision and leadership attributes as chair of PHTA's Technical committee to put into place the building blocks for the International Swimming Pool & Spa Code that now leads us in the advent of licensing.

Industry Legend Passes Away

From Jan. 9: On December 31, 2018, former PHTA Board Chair, Lawrence (Larry) Biscornet, CBP, CSP passed away in Safety Harbor, Florida. For over 50 years, Larry was active in the pool and hot tub industry and held several leadership positions within the National Swimming Pool & Spa Institute (NSPI), the Pool & Hot Tub Alliance (PHTA), The Northeast Spa and Pool Association (NESPA) and the NESPA NY/NJ Metro Chapter and was a strong advocate for pool and spa industry education. In addition to his leadership service, Larry was recognized as a 2014 PHTA Fellow. This honor is reserved for the industry's most prominent individuals who have made distinguished contributions that raise professionalism in the aquatic community through teaching, research and/or exemplary service to others. He was the owner LBI Swimming Pools and Spas out of New Rochelle, NY. PHTA sends our deepest sympathy to the family and friends. A memorial service was held on January 7 at the Espiritu Santo Catholic Church. In lieu of donations, the family asks that cards be sent to his wife Dorothy Biscornet. Those interested, can email PHTA at awells@phta.org for the address. In the spring of 2019, a memorial service will be held in the New Rochelle, NY area. Details are still pending. Future tributes to Biscornet for his service to the industry are planned. As they are released, we will keep you updated.

PHTA Announces New President and CEO Sabeena Hickman, CAE

From Aug. 14: The Pool & Hot Tub Alliance (PHTA) announced the appointment of Sabeena Hickman, CAE as PHTA's President and Chief Executive Officer and Staff Liaison to the Board of Directors effective Sept. 3. Hickman brings more than 20 years of relevant association experience to her new role, having previously served as Chief Executive Officer of the National Association of Landscape Professionals (NALP).

Texas Pool & Spa Coalition Announces New 2019-2020 Board

From Aug. 7: Last week, the Texas Pool & Spa Coalition (TPSC) announced the updated 2019-2020 Board of Directors slate. At their annual meeting on June 29, Rick Hagan of Pool Corporation assumed the role as President of the Board, with Joshua Buzzell of Regal Pools serving as the Vice President, and Bill Irvin of Preferred Pool Corp as the new Secretary/Treasurer. Will Ainsworth of Professional Pool Services of Texas rounds out the Officers as the Immediate Past President.

PHTA Education Updates Made at November Board of Directors Meeting

From Dec. 11: The Pool & Hot Tub Alliance Board of Directors made determinations on PHTA education structure and course format plans. Recommendations were made to address duplicate courses and certifications that came as a result of the unification of The Association of Pool and Spa Professionals (APSP) and the National Swimming Pool Foundation (NSPF). Most changes will go into effect in 2021.
