In light of recent Supreme and Federal Circuit decisions, especially Alice Corp. v. CLS Banking, Association for Molecular Pathology v. Myriad Genetics and Mayo v. Prometheus, it can be difficult to formulate successful intellectual property (IP) strategies in this rapidly shifting legal environment.
This session will use the case study methodology to work through these issues. You'll be provided with a framework of how to discuss patent limitations with faculty; a patent and claim strategy that meets current standards; and proper actions to take during prosecution. In addition, two case studies will be presented — one on a medical diagnostic technology and the other on a computer/software disclosure. University of Maryland Ventures has announced that the University of Maryland, Baltimore (UMB) has granted worldwide, exclusive licensing rights for a new vaccine technology to Serenta Biotechnology, LLC, a Gaithersburg, Maryland-based startup. The license is based on technology co-owned by UMB and Northern Arizona University and is the basis for a multivalent vaccine against infections caused by Staphylococcus aureus, a bacterial strain often resistant to antibiotics.

The University of Arizona has licensed an interactive training program developed at the Lowell Institute for Mineral Resources to startup Desert Saber, LLC. The program, created in collaboration with the Mel and Enid Zuckerman College of Public Health and with funding from Science Foundation Arizona, the National Institute for Occupational Safety and Health (NIOSH) and the Mine Safety and health Administration (MSHA), simulates training exercises for mining industries.

Lee, the USPTO is launching an initiative to use nearly five years of historical data and user experiences to further shape and improve Patent Trial and Appeal Board (PTAB) trial proceedings, particularly inter partes review proceedings.
The purpose of the initiative is to ensure that the proceedings are as effective and fair as possible within the USPTO’s congressional mandate to provide administrative review of the patentability of patent claims after they issue.
