After agreeing to increase the amount of bonding that Governor Lamont would allow the state to issue aid to municipalities, he got the legislature to finally agree to have a vote on truck only tolls next week. Many municipalities have been waiting for months to do local projects (ie. school construction, road paving, etc.), but have been unable to fund them without the state's assistance. The Malloy administration averaged $2.1 billion in bonding during his administration, but Lamont refused to agree to new borrowing without knowing if law makers would agree to a long-term transportation plan that included tolls.

A plan to cap emissions on vehicles that use gasoline and diesel will cost motorists approximately 17cpg to start and increase annually until people can no longer afford to use fossil fuels, is under scrutiny throughout the region. The Transportation Climate Initiative (TCI) is being pushed in 13 states covering the northeast and mid-Atlantic region, but several influential people and organizations have recently questioned the program casting some doubt on how much support the program actually has.

Last year, CEMA pushed for a new law designed to create a thermal renewable energy credit (TREC) program. The program would be similar to one used by the solar industry to incentivize the use of photovoltaic solar panels, but this one would incentivize biodiesel blending. With the state moving toward a 2030 deadline to reduce carbon emissions by 45% (and an 80% reduction by 2050), CEMA believes that a TREC program would help our members comply with these aggressive deadlines.

Some members are still having problems with the FMCSA Portal and CEMA is in contact with FMCSA to try to resolve these. In the meantime FMCSA has clarified how the Clearinghouse is to be used. First, if your drug testing company does a random test of an employee and the driver tests positive, the testing company will inform you, the employer, normally so that you can get the driver off the road. Second, if the testing company is telling you anyway of any positive tests, then why do you ever need to purchase a "query" to look at drug results?

Companies with bulk storage have to submit their Tier 2 inventory reports by March 1 every year. The EPA has new forms and new Tier 2 Submit software for this. The forms can be found here and the Tier 2 Submit software here. You need to submit these to your local fire marshal and to the state here. You are required to submit Tier 2 if you have in storage 10,000 lbs or more of heating oil (about 1250 gallons), or 75,000 gallons of gasoline at a gas station, or 100,000 gallons of diesel at a gas station.

These utility tariffs below are expressed in heating oil gallon equivalents, and so present gas rates on a British thermal unit (Btu) to Btu equivalent basis with heating oil. Rates assume about 1000 ccf/month of consumption.

Senate Republican Leader Len Fasano said he’s read the 32-page transportation package proposed by Democratic lawmakers and “it is absolutely unclear how these toll rates can get raised.” Fasano said the truck-only part of the legislation allows rates to be raised without legislative authority. The new Transportation Policy Council created in the legislation will be allowed to change the toll rate of any tolled bridge by the rate of inflation or a rate based on the construction cost index.
